HomeMy WebLinkAboutResolution 5689-02-2023 A Resolution NO. 5689-02-2023 A RESOLUTION RATIFYING THE DENIAL OF CONSENT TO THE INCLUSION OF THE CITY OF FORT WORTH'S EXTRATERRITORIAL JURISDICTION IN THE PROPOSED DENTON COUNTY EMERGENCY SERVICES DISTRICT NO. 2 WHEREAS, the City of Fort Worth, Texas (the "City"), received a letter dated December 2, 2022, requesting the City's consent to the inclusion of the City's extraterritorial jurisdiction ("ETJ") in Denton County, as shown on the map in the attached Exhibit "A", in a proposed emergency services district ("District"), to be known as Denton County Emergency Services District No. 2; WHEREAS, pursuant to Section 775.014(a) of the Texas Health and Safety Code, before an emergency services district may be created that contains territory in a municipality's ETJ, the governing body of the municipality must give consent on or before the 60th day after the date on which the municipality receives the request; WHEREAS, due to the winter weather event that occurred in North Texas, the City Council meeting scheduled for Tuesday, January 31, 2023 was canceled; WHEREAS, due to the aforementioned 60-day deadline, Mayor Mattie Parker, on behalf of the City's governing body, wrote a letter notifying counsel for the parties petitioning for the creation of the District that the City does not consent to the inclusion of any portion of the City's ETJ within the District; and WHEREAS,the City Council, as governing body, wishes to reaffirm that position and formally express that it does not consent to the inclusion of the City's ETJ in the District,but has no objection to the creation of the District for areas outside of the City's ETJ; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: That the City Council, as governing body of the City of Fort Worth, does not consent to the inclusion of the City's ETJ located within the proposed boundaries of the District,to be known as Denton County Emergency Services District No. 2 and hereby ratifies the notice of non-consent delivered by the Mayor on January 31, 2023.
