HomeMy WebLinkAboutOrdinance 17200-09-2006ORDINANCE NO. 172a0-09-zoa6 AN ORDINANCE AMENDING CHAPTER 25, "PLANNING" OF THE CODE OF THE CITY OF FORT WORTH (1986), AS AIVIENDED, BY AMENDING SECTION 25-1 TO CHANGE THE FEES FOR CERTAIN SERVICES RELATED TO ZONING BOARD OF ADJUSTMENT, ZONING COMMISSION, AND PLAN COMMISSION FUNCTIONS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY CLAUSE; PROVIDING FOR PUBLICATION IN TIE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY TIME CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Chapter 25 of the Code of the City of Fart'4Varth, Texas (1986}, as amended, is hereby amended by revising Sectiori 251 to read as follows: Sec. 25-1. SECTI®N 2. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986}, as amended, except where the provisions of this ordinance are in, direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Cade are hereby repealed. ~ECTIOl`l 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would. have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. ~ECTIOIV 4. Any person, f rm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Five I-lundred Dollars ($500.00) for each offense. Each day that a violation exists shall constitute a separate offense. ~ECTIOIi~ 5. AlI rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Ordinance No. 3411, Ordinance No. 13890 or any other ordinances affecting zoning which have accrued at the time of the effective date of this ordinance, and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. 4 SEC7['IOlV 6. It is recommended that the City Council adopt the attached ordinance establishing various fees relating to the following services: 1. Annexation, City Council variances and miscellaneous fees with an effective date of October 24, 2006; 2. Zoning fees with an effective date of October 1©, 2006; 3. Plat and applications fees for Plan Commission actions with an effective date of October 24, 2006; 4, Board of Adjustment variances ar special exceptions for residential uses with an effective date of October 17, 2006; and 5. Baard of Adjustment variances or special exceptions far commercial uses with an effective date of October 3, 2006 DISCUSSION: As a result of the Zucker Study that was presented to the City Council in May of this year, City staff recommended a 10% interim fee adjustment in most categories to fund personnel and technology resources that could significantly improve the performance of the Development Department. This is a temporary measure pending the completion of a fee study by Zucker Systems which is scheduled to occur in November of this year. The purpose is to fully evaluate the cost of our sen+ices so the City Council is able to evaluate the level of cost- recovery that is appropriate. A full report is expected to be presented to the City Council in the first calendar quarter of 2007. This ordinance will establish the interim rate structure until the full report has been accepted It is anticipated that the proposed adjustments will generate approximately $91,400 in additional revenue. Approval of the attached ordinance will establish varying effective dates in order to coincide with filing deadlines for the corresponding Board or Commission. FISCAL INFORNIATIONICERTIFICATION: The Finance Director certifies that the Development Department will be responsible for the collection of revenues due to the City.
