AND USE OF, THE PUBLIC STREETS OF THE CITY OF FORT WORTH BY VEHICLES OF ALL KINDS; RESTRICTING THE MANNER IN WHICH VEHICLES SHALL BE BACKED; PROHIBIT- ING THE BACKING OF VEHICLES INTO OR ACROSS INTER- SECTIONS OR AROUND CORNERS; PROVIDING A SAVINGS CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF OTHER ORDINANCES REGULATING THE MOVEMENT OF TRAFFIC; RE- PEALING ALL ORDINANCES IN CONFLICT HEREWITH; PRO- VIDING A PENALTY FOR THE VIOLATION THEREOF; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 49 of Chapter 25 of the Code of the City of Fort Worth, 1950, be amended so that hereafter the same shall be and read as follows: Sec. 49. Backing. The driver of a vehicle shall not back the same unless such movement can be made in safety. In so backing, he shall yield the right of way to other vehicular traffic. In no event shall this section be construed in such a manner as to permit the backing of a motor vehicle into or across an intersection of public streets or to permit the backing of a motor vehicle so as to turn same from a street into an intersecting street. SECTION 2. Should any section, clause or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of this ordinance as a whole or any part thereof other than the part so declared to be invalid. SECTION 3 . That this ordinance shall repeal every prior ordinance in conflict herewith, but only insofar as the portion of such prior ordinance shall be in conflict, and as to all other sections of ordinances not in direct conflict herewith, this ordinance shall be and is hereby made cumulative except as to such ordinances or portions thereof as are expressly repealed hereby. SECTION 4. That any person who violates, disobeys, omits, neglects or refuses to comply with any provision of this ordinance shall be guilty of a misdemeanor and shall be punished by a fine not to exceed Two Hundred Dollars ($200.00) . SECTION 5. That this ordinance shall become effective and be in full force and effect from and after its passage and publication as required by law. APPROVED AS TO FORM AND LEGALITY: City Attorney
