HomeMy WebLinkAboutOrdinance 5343 ORDINANCE NO. 6--3-,V4.� AN ORDINANCE REGULATING THE OPERATION OF TAXICABS, BUSES AND OTHER VEHICLES FOR HIRE ON PUBLIC STREETS BY AMENDING CHAPTER 34, SECTION 34-9 OF THE CODE OF THE CITY OF FORT WORTH, uxA4 1964; By INCREAS- ING STREET RENTAL FEES; MAKING THIS ORDINANCE CUMULATIVE OF ALL PRIOR ORDINANCES; REPEALING CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE C171f COUNCIL (IF THE CM OF FORT WORTH, TEXAS' SECTION to That Chapter 34, Section 34-9 of the Code of the City of Fort Worth, Texas, 1964, is hereby amended and after having been so amended shall here- after read as follows: Sec. 34-9. Same---Fee; when fee payable. As compensation or rental or license fee for the privilege of operating upon and using the public streets, alleys and thoroughfares of the city in conducting and carrying on the business of transporting passengers for com- pensation on and over such streets and thoroughfares in taxicabs, each holder of a franchise or grant made under the terms of this chapter shall. pay to the city at the office of the commissioner of accounts an amount equivalent to three per cent of the gross revenues derived from the operation of taxicabs operated by him, which amount shall be paid monthly for each calendar month on or before the fifteenth day of each succeeding calendar month. The com- pensation provided for herein shall be in lieu of all other fees to be paid by taxicab operators imposed by any other ordinance now in force, but shall not be construed to be in lieu of any validly assessed ad valorem taxes. (Ord. No. 3364, art, 3.) SECTION 2. This ordinance shall be and is hereby declared to be canulative of all other ordinances of the City of Fort Worth providing for the regulation of motor vehicles upon the public streets, and this ordinance shall not operate to repeal or affect any of such other ordinances oxcept, insofar as the pro- visions thereof might be inconsistent or in conflict with the provisions of this ordinance, in which event such conflicting provisionss if any, in such other ordinance or ordinances are hereby repealed. SECTION 3- If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such holding shall not affect the validity of the remaining portions of this ordinance, and all of the re- mainder of this ordinance not so held to be unconstitutional shall continue to be in full force and effect.
