C00005) IN THE AMOUNT OF $49,0000.00 AND DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PUBLIC ART-2004 CIP PROGRAMMABLE PROJECT (CITY PROJECT NO. P00068) BY THE SAME AMOUNT; AND (2) DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PUBLIC ART-2004 CIP PROGRAMMABLE PROJECT (CITY PROJECT NO. P00068)IN THE AMOUNT OF $206,774.10 IN AN EFFORT TO CLOSE OUT THE PROJECT, PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2022- 2023 in the Budget of the City Manager, there shall also be adjusted estimated receipts and appropriations in the Street Improvements Fund, by (1) increasing estimated receipts in the SH 121 T (Southwest Parkway) project (City Project No. C00005) in the amount of $49,000.00 and decreasing estimated receipts and appropriations in the Public Art-2004 CIP Programmable Project (City Project No. P00068) by the same amount and (2) decreasing estimated receipts and appropriations in the Public Art-2004 CIP programmable project (City Project No. P00068) in the amount of$206,774.10 in an effort to close out the project. SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Street Improvements Fund by increasing estimated receipts in the SH 121 T(Southwest Parkway) project(City Project No. C00005) in the amount of$49,000.00 and decreasing estimated receipts and appropriations in the Public Art-2004 CIP Programmable project(City Project No. P00068) by the same amount; 2. Adopt the attached appropriation ordinance decreasing estimated receipts and appropriations in the Street Improvements Fund in the Public Art-2004 CIP Programmable project(City Project No. P00068) in the amount of$206,774.10 in an effort to close out the project; and 3. Amend the Fiscal Years 2023-2027 Capital Improvement Program. DISCUSSION: The purpose of this Mayor and Council Communication (M&C)is to provide for public art capital project clean-up as identified throughout the fiscal year. Items that need clean up may include but are not limited to actions such as authorizing transfers,balancing receipts and appropriations for primarily completed projects to facilitate closing, provide correcting budget transfers and general ledger entries to prepare for project closure or to balance a project, move additional or residual receipts and appropriations to the appropriate capital project fund, and other ancillary actions to fulfill capital obligations as needed. As the City of Fort Worth(City)has enhanced budgetary and expenditure controls,these requested items seek approval for transparency and control purposes.To the extent possible,each request has been reviewed by the Planning and Data Analytics Department, Budget Division in conjunction with the participating departments for accuracy and completeness. Items addressed in this M&C are as follows: Recommendation 1 will balance project C00005-SH 121 (Southwest Parkway) so that it can be closed and inactivated. Project C00005 is the SH-121 Tollway(Southwest Parkway)which extends over 8 miles from downtown(I1-1-30)to southwest Fort Worth(FM 1187).The project was completed in 2017 and has had no activity since. In 2018,an administrative error of moving funds created a financial imbalance in the project. Approval of this recommendation will appropriate the necessary funds to balance the project so that it can be closed and inactivated. Recommendation 2 will close out the Public Art-2004 CIP programmable Project(City Project No. P00068)and move residual receipts to the Unspecified-Public Art Enhancement project(City Project No. UNSPAE). This action will allow for public art-related projects to receive future funding appropriations with Council approval. Funding for this project was not included in the FY2023-2027 Capital Improvement Program due to these projects being completed and only requiring fiscal transactions to balance and close the projects and move residual budget to the Unspecified project for future appropriations. The action in this M&C will amend the FY2023-2027 Capital Improvement Program as approved in connection with Ordinance 25773-09-2022. Funding is budgeted in the Street Improvements Fund for the purpose of funding the SH 121 T(Southwest Parkway)project and Unspecified- Public Art Enhan project. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are currently available in the Public Art-2004 CIP project within the Street Improvements Fund,and upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds will be available in the Street Improvements Fund for the SH 121 T(Southwest Parkway)project and the Unspecified-Public Art Enhan project.
