HomeMy WebLinkAboutOrdinance 5441 ORDINANCE NO. ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF LIVINGSTON AVE. AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT 4,ITH S.R.O. ASPHALT, INC., ARLINGTON, TEXAS FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL A33ESS- MENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS, DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAP- TION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with S.R.Q. Asphalt. Inc.. Arlington. Texas for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to—wit: 1. Livingston Avenue' From Ripy Street to Biddison Street, known and designated as Unit No. 1, a 6 inch hot-mix asphaltic concrete surface on a 30 foot roadway. 2. McCart Street: From the south property line of Lot 6, Block 68, Seminary Hill Addition to Boyce Street, known and designated as Unit No. 2, a 71 inch hot-mix asphaltic concrete surface on a 40 foot roadway. 3. McCart Street: From Boyce Street to Spurgeon Street, known and designated as Unit No. 3, a 72 inch hot-mix asphaltic concrete surface on a 40 foot roadway. 4. McCart Street: From Spurgeon Street to Bilglade Avenue, known and designated as Unit No. 4, a 72 inch hot-mix asphaltic concrete surface on a 40 foot roadway. 5. McCart Street: From Bilglade Avenue to Martin Lydon Street, known and designated as Unit No. 5, a 72 inch hot-mix asphaltic concrete surface on a 40 foot roadway. 6. McCart Street: From Martin Lydon Street to Yates Street, known and designated as Unit No. 6, a 72 inch hot-mix asphaltic concrete surface on a 40 foot roadway. 7. McCart Streets From Yates Street to Covert Street, known and designated as Unit No. 7, a 72 inch hot-mix asphaltic concrete surface on a 40 foot roadway. 8. Devitt Street: From Bryan Street to Stuart Street, known and designated as Unit No. 3, a 6 inch hot-mix asphaltic concrete surface on a forty foot roadway. 9. Devitt Street: From Stuart Street to South Jones Street, known and designated as Unit No. 9, a 6 inch hot-mix asphaltic concrete surface on a 40 foot roadway. 10. Devitt Street: From South Jones Street to South Grove Street, known and designated as Unit No. 10, a 6 inch hot-mix asphaltic concrete surface on a 40 foot roadway. 11. South Jones Street: From Devitt Street to Shaw Street, known and designated as Unit No. 11, a 6 inch hot-mix asphaltic concrete surface on a 40 foot roadway. 12. South Jones Street: From Shaw Street to Bewick Street, known and designated as Unit Ho. 12, a 6 inch hot-mix asphaltic concrete surface on a 40 foot roadway. 13. South Jones Street: From Bewick Street to Biddison Street, known and designated as Unit No. 13, a 6 inch hot-mix asphaltic concrete surface on a 40 foot roadway. 14. Stuart Street: From Biddison Street to Bewick Street, known and designated as Unit No. 14, a 6 inch hot-mix asphaltic concrete surface on a 30 foot roadway. 15. Fogg Street: From May Street to St. Louis Street, known and designated as Unit No. 15, a 6 inch hot-mix asphaltic concrete surface on a 30 foot roadway. 16. Fogg Street: From St. Louis Street to Bryan Street, known and designated as Unit NQ. 16, a 6 inch hot-mix asphaltic concrete surface on a 30 foot roadway. 17. Fogg Street: From Bryan Street to Jones Street, known and designated as Unit No. 17, a 6 inch hot-mix asphaltic concrete surface on a 30 foot roadway. 18. Fogg Street: From Jones Street to North-South Freeway, known and designated as Unit No. 18, a 6 inch hot-mix asphaltic concrete surface on a 30 foot roadway. 19. Fairpark Boulevard: From Prince Street to Eugene Avenue, known and designated as Unit No. 19, a 6 inch hot-mix asphaltic concrete surface on a 36 foot roadway. 20. Fairpark Boulevard: From Eugene Avenue to Hathcox Avenue, known and designated as Unit No. 20, a 6 inch hot-mix asphaltic concrete surface on a 36 foot roadway. 21. Fairpark Boulevard: From Hathcox Avenue to Amspoker Avenue, known and designated as Unit No. 21, a 6 inch hot-mix asphaltic concrete surface on a 36 foot roadway. 22. Fairpark Boulevard: From Amspoker Avenue to Debbie Street, known and designated-as Unit No. 22, a 6 inch hot-mix asphaltic concrete surface on a 36 foot roadway. 23. Fairpark Boulevard: From Debbie Street to Blalock Avenue, known and designated as Unit No. 23, a 6 inch �isphaltic hot-mix concrete surface on a 36 ;foot roadway. 24. Fairpark Boulevard: From Blalock Avenue to Blodgett Avenue, known and designated as Unit No. 24, a 6 inch hot-mix asphaltic concrete surface on a 36 foot roadway. 25. Debbie Street: From Fairpark Boulevard to the east property line of Lot 38, Block 14, Fairview Heights Addition, known and designated as Unit No. 25, a 6 inch hot-mix asphaltic concrete surface on a 30 foot roadway. 26. Amspoker Avenue- From Fairpark Boulevard to the east property line of Lot 38, Block 13, Fairview Heights Addition, known and designated as Unit No. 26, a 6 inch hot-mix asphaltic concrete surface on a 30 foot roadway. WHEREAS, by sundry proceedings heretofore passed �b the City Council of the City of Fort Worth, Texas, including Ordinance No,9.5234 &, �a 1ortion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of FortV4orth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial ,justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance Ncr, 5234 & 5261 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, TIIE&FORE, BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT. xe The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed, II, The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments, The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed andshall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: ilk. When each of the certificates has been duly executed as hereinabove provid- ed, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. In order to correct this con- dition, it was necessary to construct subdrains . + $14,115.50 2) Based on soil constants of the subgrade obtained from test holes during plan preparation, it was estimated that lime stabilization of the subgrade would be necessary on about 50 per cent of this project; however, during construction, it was Bete fined that about 87 per cent of the project required lime stabilization. + 9,960.72 3) During construction, not as many utility adjust- ments were required as originally estimated. - 7,842.13 4) Variation between estimated and measured quantities account for the reamining difference between contract price and contract cost. - 24,375-18 Total Overrun $13,858.911J� C.oggliance with §2,ecifications Attached is a tabulation of paving test cores on twenty units of a, inch travel base and 6-inch hot-mix asphaltic concrete type pavemien't showing compliance with specifications within construction tolerances. 'Within Tolerance Tolerance Surface 54 20 13 0 Base 80 7 0 0 The 87 pavement cores averaged 6.11 inches as compared witti 6.0 inches specified and the 87 base cores averaged 4.56 inches as compared to 4.0 inches specified. Tests de during construction of sub-base, base and pavement show that the material used was in compliance with specifications. Also attached is a tabulation of paving test cores of 6 inch lime treated subgrade and 7.5 inch hot-mix asphaltic concrete type Pavement during and after construction on the six units on cCart Street. Units 2, and 3 showed compliance with specifications within, construc- tion tolerances. Units 4, 5, 6 and 7 showed marginal compliance to depth requirements. Based on additional cores taken, areas Where the hot-mix asphaltic concrete pavement was found deficient in excess of one-half inch thickness were overlaid with hot-mix asphaltic concrete to acceptable thickness as shown, on the core tabulations. During testing on these units on Mr-Cart Street, 35 original corings were made with the following results: Exceeds Even With Under Specs But Below layL=4 Specs. Specs. Within Tolerance Tolerance Surface 13 3 11 8 The 35 pavement cores averaged 7.39 inches as cDsTpared with 7.5 inches specified. Areas on Units 4, 5, 6 and 7 which showed marginal compliance were overlaid with additional hot-mix asphaltic concrete in order to comply with an acceptable thickness. The base material on Mc Cart Street is 6 inch limed sub-grade over uihioh 7.5 inches of hot-mix asphaltic concrete was applied. It was not pos- sible to make corings by wet drilling method after construction. The sub-grade depths were measured during construction and found to be in compliance with specifications.
