AN ORDINANCE CALLING AND ORDERING A SPECIAL ELECTION
OF THE QUALIFIED VOTERS OF THE CITY OF FORT WORTH,
TEXAS, TO BE HELD ON TUESDAY, APRIL 12, 1966, TO DE-
TERMINE WHETHER OR NOT THE CITY COUNCIL SHALL BE
AUTHORIZED TO ADOPT A RESOLUTION IMPLEMENTING URBAN
RENEWAL; PROVIDING FOR THE FORM OF NOTICE THEREOF;
PROVIDING FOR ABSENTEE VOTING: PROVIDING FOR THE
USE OF VOTING MACHINES; PRESCRIBING OFFICIAL BALLOTS;
PROVIDING THAT SAID ELECTION BE HELD IN CERTAIN
PLACES DURING A CERTAIN TIME; APPOINTING PRESIDING
JUDGES FOR EACH PRECINCT; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, pursuant to a resolution duly adopted by the
City Council of the City of Fort Worth, Texas, on January 3,
1966, and a notice duly published twice in the Fort Worth Star-
Telegram the newspaper officially designated by the City Coun-
cil, such publishings being in the Tuesday, January 4, 1966,
and in the Wednesday, January 5, 1966, editions of such news-
paper, the said City Council met in the Council Chamber at
the City Hall in said City on Monday, March 7, 1966, beginning
at 9:30 A. M. , Central Standard Time, and during such time and
at such place considered the question of whether it would order
an election by the qualified voters residing in the City, own-
ing taxable property within the boundaries thereof, who have
duly rendered the same for taxation, to determine whether or
not the City Council shall be authorized to adopt a resolution
implementing urban renewal in accordance with the Urban Re-
newal Law of the State of Texas, Article 1269L-3, Revised
Civil Statutes; and,
WHEREAS, after due consideration of the said question,
the City Council has determined to call said election; NOW,
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION I.
That in accordance with the provisions of the Urban Re-
newal Law of Texas, Article 1269L-3, Revised Civil Statutes,
a special election be, and the same is hereby, called and
ordered to be held on Tuesday, April 12, 1966, within the cor-
porate limits of the City of Fort Worth, Texas, to determine
whether or not the said City Council should adopt a resolution
as set forth in the form of notice contained in Section III
hereof.
SECTION II.
That only qualified voters residing in the City of Fort
Worth, Texas, owning taxable property within the boundaries
thereof, who have duly rendered the same for taxation, shall
be entitled to vote at such election.
SECTION III.
That it is hereby ordered that at least thirty (30) days '
notice of the special election herein called and ordered shall
be given in the manner required by the applicable provisions of
the laws of the State of Texas and the Charter and ordinances
of the City of Fort Worth, Texas, with respect generally to
special elections in the said City; and that the notice to be
given shall be substantially as follows:

"NOTICE OF SPECIAL ELECTION IN THE CITY OF
FORT WORTH, TEXAS, CONCERNING THE ADOPTION
BY THE CITY COUNCIL OF A RESOLUTION IN AC-
CORDANCE WITH THE URBAN RENEWAL LAW OF TEXAS.
"Pursuant to the applicable provisions of the
laws of the State of Texas and the Charter and
ordinances of the City of Fort Worth, Texas, in-
cluding particularly the Urban Renewal Law of
Texas, Article 1269L-3, Revised Civil Statutes,
notice is hereby given that a special election
shall be held in the said City on Tuesday, April
12, 1966, from 7 :00 A. M. to 7t00 P. M. , Central
Standard Time, to determine whether the City
Council of the said City shall be authorized to
adopt a resolution as follows:
A RESOLUTION MAKING CERTAIN FIND-
INGS AND DETERMINATIONS UNDER AND
PURSUANT TO THE URBAN RENEWAL LAW
OF TEXAS, AND PROVIDING FOR THE
EXERCISE OF POWERS BY THE CITY OF
FORT WORTH, TEXAS, FOR THE PURPOSE
OF URBAN RENEWAL, INCLUDING THE
EXERCISE OF THE POWER OF EMINENT
DOMAIN WHERE NECESSARY.
BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF FORT WORTH, TEXAS:
Section 1.
It is hereby found and determined
that one or more slum or blighted
areas exist in the City of Fort Worth.
Section 2.
It is hereby further found and de-
termined that the rehabilitation, con-
servation or slum clearance and rede-
velopment, or a combination thereof,
of such slum or blighted area or areas
is necessary in the interest of public
health, safety, morals or welfare of
the residents of the City of Fort Worth.
Section 3.
It is hereby further determined that
all provisions of the Urban Renewal Law

of the State of Texas, Article 1269L-3,
Revised Civil Statutes, shall be and are
hereby expressly incorporated herein,
and the City of Fort Worth shall exercise
all or any part or combination of powers
granted thereunder which would otherwise
be exercised by an urban renewal agency
if such agency were created.
Section 4.
Without in any way circumscribing or
limiting the powers which the City of
Fort Worth shall exercise in accordance
with the said Urban Renewal Law and
Section 3 hereof, it is further de-
termined that the said City shall have
the power to:
A. Borrow money and to apply for
and accept advances, loans,
grants, contributions and any
other form of financial assist-
ance from the Federal Govern-
ment, the State, County or other
public body or from any sources,
public or private, for the pur-
poses of the said Urban Renewal
Law, to give such security as
may be required, and to enter
into and carry out contracts in
connection therewith. The said
City may include in any contract
for financial assistance with
the Federal Government for an
urban renewal project such pro-
visions and conditions imposed
pursuant to Federal Law as the
said city may deem reasonable
and appropriate and which are
not inconsistent with the pur-
poses of the said Urban Renewal
Law.
B. Issue bonds from time to time in
its discretion to finance the
undertaking or interim financing
of any urban renewal project under
the said Urban Renewal Law, in-
cluding, without limiting the
generality thereof, the payment of

principal and interest upon any ad-
vances for surveys and plans; and
issue refunding bonds for the pay-
ment or retirement of such bonds
Previously issued by it. Such
bonds shall be made payable, as to
both principal and interest, solely
from the income, proceeds, revenues,
and funds of the said City derived
from or held in connection with its
undertaking and carrying out of ur-
ban renewal projects under the said
Urban Renewal Law; provided, however,
that payment of such bonds, both as
to principal and interest, may be
further secured by a pledge of any
loan, grant or contribution from the
Federal Government or other source,
in aid of any urban renewal projects
of the said City under the said Urban
Renewal Law, and by a mortgage of
any such urban renewal projects, or
any part thereof, title to which is
in the said City. Any bonds issued
hereunder or pursuant to Section
15(d) of said Article 1269L-3 shall
not be subject to the provisions of
any other law relating to the authori-
zation, issuance or sale of bonds.
C. Redeem such bonds as may be issued
pursuant to Section 4.B. hereof or
pursuant to Section 15(d) of said
Article 1269L-3 at the redemption
price established therein or to
purchase such bonds at less than
redemption price, all such bonds
so redeemed or purchased to be can-
celled.
D. Issue and sell its general obligation
bonds for the purpose of aiding in
the planning, undertaking or carry-
ing out of an urban renewal project
of the said City. This power shall
be in addition to the power to issue
bonds pursuant to Section 4.B. hereof
or pursuant to Section 15(d) of the
said Article 1269L-3. Any general ob-
ligation bonds issued by the City
shall be issued in the manner and with-

in the limitations prescribed by the
laws of the State of Texas for the
issuance and authorization of bonds
by the said City for public purposes
generally.
Section 5.
It is hereby further determined that
the City of Fort Worth, in implementing
and carrying out urban renewal, shall
exercise for urban renewal purposes all
of the privileges, rights and powers,
including the exercise of the power of
eminent domain, vested or to be vested
in the said City, however conferred,
including but not limited to the powers
in Chapter II of the City Charter of the
City of Fort Worth, which include the
power to borrow money on the faith and
credit of the said City by the issue or
sale of bonds or notes of the said City.
Section 6.
It is the intention of the City Coun-
cil that the findings and determinations
herein made are in accordance with, and
the various terms used herein are used in
the same sense as used or defined in,
the said Urban Renewal Law of Texas,
Article 1269L-3, Revised Civil Statutes
of Texas.
"Only legally qualified voters residing in the
City of Fort Worth, owning taxable property with-
in the boundaries thereof, who have duly rendered
the same for taxation, shall be entitled to vote
at said special election.

SECTION IV.
That voting machines approved by the Commissioners '
Court of Tarrant County, Texas, shall be used at the special

election herein called and ordered to be held on Tuesday,
April 12, 1966; and that such use of voting machines shall
be in strict compliance with the applicable provisions of
Article 7.14 of the Election Code of the State of Texas, as
amended, and other applicable provisions of such Election
Code.
SECTION V.
That the official ballots to be used in the said vot-
ing machines shall be in compliance with the applicable pro-
visions of Article 7.14 of the said Election Code and shall
have written or printed thereon the following:

It is hereby found and determined that one or more

SECTION 2.
It is hereby further found and determined that the re-
habilitation, conservation or slum clearance and redevelop-
ment, or a combination thereof, of such slum or blighted area
or areas is necessary in the interest of public health, safe-
ty, morals or welfare of the residents of the City of Fort
Worth.

SECTION 3.
It is hereby further determined that all provisions
of the Urban Renewal Law of the State of Texas, Article
1269L-3, Revised Civil Statutes, shall be and are hereby
expressly incorporated herein, and the City of Fort Worth
shall exercise all or any part or combination of powers
granted thereunder which would otherwise be exercised by
an urban renewal agency if such agency were created.
SECTION 4.

of, it is further determined that the said City shall have
the power to:

tribution from the Federal Government or
other source, in aid of any urban renewal
projects of the said City under the said
Urban Renewal Law, and by a mortgage of any
such urban renewal projects, or any part
thereof, title to which is in the said City.
Any bonds issued hereunder or pursuant to
Section 15(d) of said Article 1269L-3 shall
not be subject to the provisions of any
other law relating to the authorization,
issuance or sale of bonds.
C. Redeem such bonds as may be issued pursuant
to Section 4.B. hereof or pursuant to Sec-
tion 15(d) of said Article 1269L-3 at the
redemption price established therein or to
purchase such bonds at less than redemption
price, all such bonds so redeemed or pur-
chased to be cancelled.
D. Issue and sell its general obligation bonds
for the purpose of aiding in the planning,
undertaking or carrying out of an urban re-
newal project of the said City. This power
shall be in addition to the power to issue
bonds pursuant to Section 4.B. hereof or
pursuant to Section 15(d) of the said Article
1269L-3. Any general obligation bonds is-
sued by the City shall be issued in the man-
ner and within the limitations prescribed
by the laws of the State of Texas for the
issuance and authorization of bonds by the
said city for public purposes generally.
SECTION 5.
It is hereby further determined that the City of Fort

That absentee voting shall be on paper ballots which
shall have printed thereon the following:

the resolution shall have written or printed on their ballots

"FOR ADOPTION,"
and those absentee voters opposed to the adoption of the reso-
lution shall have written or printed on their ballots the words:
"AGAINST ADOPTION."

SECTION VII.
That the City Secretary is hereby authorized and di-
rected to prepare and issue such ballots for voting machines
and for absentee voting and to stamp same "Official Ballot."
SECTION VIII.
That the City Secretary of the City of Fort Worth,
Texas, is hereby authorized and directed to cause notice of
said special election to be given by publishing the notice of
election contained in Section III hereof in the Fort Worth
Star-Telegram in the Tuesday, March 8, 1966, edition of such
newspaper, and the City Secretary is further authorized and
directed to cause a substantial copy of the said notice of
election to be posted in each of the election precincts of
the said City and also at the City Hall; and the City Secre-
tary shall see that proper publication is made and proper
notice of this election is given, in full conformity with
the Charter of the City of Fort Worth, Texas, and the appli-
cable statutes of the State of Texas. That the way and man-
ner of holding this election, the polling places, the per-
sonnel of the officers, precinct judges and substitutes there-
for who are to hold the same, and all details connected with
the holding of the election shall be determined and arranged
by the City Council and administered under the direction of
and by the City Secretary.
SECTION IX.
That the polls shall be kept open from 7:00 A. M. until

7:00 P. M. , Central standard Time, on Tuesday, April 12,
1966, and the said special election shall be held in the
