HomeMy WebLinkAboutOrdinance 17208-09-2006ORDINANCE N0. 17208-09-2006 AN ORDINANCE AMENDING SECTIONS 35-56(g} and 35-56{h} OF CHAPTER 35 OF THE CODE OF THE CITY OF FORT WORTH (198b), AS AMENDED, BY REVISING AND ADDING CERTAIN RATES AND CHARGES; MAKING THIS ORDINANCE CUMU- LATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT HEREWTTH; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SEC'T`ION 1. That Section 35-56{g) of Chapter 35 of the Code of the City of Fort Worth (1986), as amended, is hereby amended to be and read as follows: (g) The following schedule of rates per month, or fraction thereof, shall be the charges to all wholesale customers far furnishing water to such customers: RATE FOR WHOLESALE WATER SERVICE Volume ($/1,000 gallons)* $ 0.6291 Maximum. Day {$/MGD excess) 106,839.00 Maximum Hour ($/MGD excess) 21,903.00 Customer {$/Meter/Month) 25.00 *plus raw water cost RAW WATER SERVICE All use per month $0.6456 per 1,000 gallons inside Tarrant Regional Water District All use per month $0.6877 per 1,000 gallons outside Tarrant Regional Water District SECTION 2. That Section 3S-Sb(h) of Chapter 3S of the Code of the City of Fort Worth {1986) as amended, is hereby amended to be and read as follows: (h) The following schedule of rates per month, ar fraction thereof, shall be the charges to all wholesale customers far furnishing wastewater services to such customers: RATE FOR WHOLESALE WASTEWATER SERVICE Volume ($/1,000 gallons} $ 0.8647 BOD {$/pound) 0.3128 TSS ($/pound) 0.1956 Customer ($/month) 75.00 SEC"~"~®N 3. This ordinance shall be cumulative of all provisions of ordinances and of the Cade of the City of Fort Worth, Texas {1986}, as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinance and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SI~CTII®N 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment ox decree of any court of competent jurisdiction, such unconstitutionality shall not affect any remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. DISCUSSION: Each year a wholesale wastewater rate study is prepared in accordance with the terms of the uniform wholesale customer contracts. 1=or fiscal year 2007, the wholesale water cost of service study was completed by Water Department staff based on the wholesale water cost of service study completed by Red Oak Consulting {a division of Malcolm Pirnie} for fiscal year 2006. The wholesale wastewater cost of service study was performed by Water Department staff based an the wholesale wastewater cost of service study completed by Black & Veatch for fiscal year 2x05. The result of these studies indicated the rates, as proposed below, will recover the cost of providing wholesale water and wastewater service. A joint meeting of the Wholesale Water Advisory Committee and the Wholesale Wastewater Advisory Committee was held July 20, 2006, to present the study and the rate requirements. Adjusted far street rental and system loss, the raw water charge to customers is $0.6456 inside the district and $0.6877 outside the district and is a direct "pass through" to wholesale water customers.
