ORDINANCE NO. ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF OLD ALM�ERIRO AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORIM, TEXAS; DECLARING THE CONTRACT WITH J. L. I 29 FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF' CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO- PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with J. L. 212'. U-! for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, tawlt: 1. OLD GRLMURY R00: FrOaL Interz�k,,La South of Washer C, r ,320 -to 3`57-31 Avtnue, luiown ;r.4,ncl designatea as Unit 1, Project 11702. 104-2300C103- WHERE&S, by sundry proceedings heretofore passed by the City Council of the ''ity of Fort Worth, Texas, including Ordinance No. Jjj9_, a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places slid against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice &nd equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 566 —, and WKEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY CCUNCUL OF THE CITY OF FORT WORTH, TEXAS, THAT- The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; .and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. The Mayor, be, and he is hereby, directed to issue and execute in the name of the Cityv certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is earected to attest same and impress thereon the corporate seal of the City, all in accordance- with the ,proceedings relating to such improvements and assessments, The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore ),vied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows- When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City.
