FORT WORTH LOCAL DEVELOPMENT CORPORATION
RESOLUTION
OF THE BOARD OF TRUSTEES
Approval of an Agreement with Housing Channel and Related Affiliates for
the Development of 5401 and 5425 E. Bevy Street, Fort Worth, Texas,
Contingent on Receipt of New Market Tax Credits
WHEREAS, the Fort Worth Local Development Corporation ("Corporation") is an
active party to the development of a proposed mixed use development located along Lancaster
Avenue between Throckmorton Street and Jennings Street in order to promote revitalization of
the area and to benefit the citizens of Fort Worth by creating affordable housing, retail, jobs and
commercial opportunities in an area in need of revitalization;
WHEREAS, Fort Worth Housing Finance Corporation, a Texas housing finance
corporation ("FWHFC"), purchased 5401 E. Berry, Fort Worth, Texas in 2004 for $15,180.60
from the City of Fort Worth, on its own behalf and as trustee for various other taxing entities for
a potential development for affordable housing, which development did not occur;
WHEREAS, the City of Fort Worth, on its own behalf and as trustee for other taxing
entities (collectively, "Taxing Entities"), received 5425 E. Berry, Fort Worth, Texas, when it was
struck off to the City of Fort Worth following an unsuccessful Constable's sale;
WHEREAS, consistent with the economic development objectives of the Fort Worth
Local Development Corporation ("Corporation"), the Corporation purchased 5401 E. Berry, Fort
Worth, Texas from the FWHFC and 5425 E. Berry, Fort Worth Texas from the Taxing Entities
in 2013 (collectively, the "Property");
WHEREAS, the Property is approximately 3.7 acres of vacant land (and is the site of a
former Dairy Queen), and is located in a Neighborhood Empowerment Zone, an Enterprise Zone,
and an area eligible for (i) Community Development Block Grant (CDBG) funds from the
United States Department of Housing and Urban Development (HUD) and (ii) New Market Tax
Credits;
WHEREAS, Housing Channel (formerly known as Tarrant County Housing Partnership)
is a certified 501(c)(3) housing nonprofit organization, and is a Community Housing
Development Organization (CHDO), as defined by HUD, to address critical revitalization needs
in targeted areas of the City and County;
WHEREAS, Housing Channel and Corporation wish to develop a mixed -use project
("Project") on the Property, consisting of a commercial and residential, including single-family
attached homes with rear -access garages and front yards with public access easements, with units
of either two or three stories in height, and a property owners association;
WHEREAS, the Project is eligible for New Market Tax Credits (NMTC), which is a
federal tax program that attracts private capital into low-income communities by permitting
individual and corporate investors to receive a tax credit against their federal income tax in
exchange for making equity investments in specialized financial intermediaries; and

WHEREAS, Corporation desires to enter into an agreement with Housing Channel and
related affiliates for the development of the Property, contingent upon receipt of NMTC for the
Project.
NOW, THEREFORE, BE IT RESOLVED that, an agreement with Housing Channel
or its affiliates for the development of the Property, contingent upon receipt of NMTC for the
Project (the "Agreement"), is hereby authorized;
FURTHER RESOLVED that the Board approves the application for NMTC for the
Project ("NMTC Application").
FURTHER RESOLVED that any authorized signatory is authorized to execute and
deliver the Agreement and the NMTC Application for and on behalf of the Corporation along
with any related documents necessary to implement the Agreement and the NMTC application,
and each may extend, modify and amend the Agreement and the application, provided any such
extensions, modifications and amendments are in compliance with all applicable laws and
regulations and the goals and purposes of the Corporation as amended from time to time
FURTHER RESOLVED, this Resolution takes effect from the date of its adoption.
