AUTHORIZING AN AGREEMENT WITH THE TEXAS
DEPARTMENT OF TRANSPORTATION FOR CONSTRUCTION,
MAINTENANCE, AND OPERATION OF A SAFETY LIGHTING
SYSTEM WITHIN STATE HIGHWAY 183 (AKA NE 28TH STREET)
FROM NICHOLS STREET TO DECATUR AVENUE.
WHEREAS, the City has requested that the State contribute financial aid for
the construction of a safety lighting system on a portion of the highway designated
as State Highway 183 (AKA NE 28th Street) ("SH 183") from Nichols Street to
Decatur Avenue inside the City; and
WHEREAS, the Executive Director, acting for and on behalf of the Texas
Transportation Commission, has made it known to the City that the State will
construct said highway lighting system, conditioned that the City will maintain
and operate said lighting system.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF FORT WORTH, TEXAS:
That the City Manager is hereby authorized to execute an Agreement for
Construction, Maintenance, and Operation of the Safety Lighting System on
State Highway 183 from Nichols Street to Decatur Avenue.

RECOMMENDATION:
It is recommended that the City Council adopt the attached resolution authorizing execution of an agreement with the Texas Department of
Transportation for construction, maintenance, and operation of a safety lighting systems within State Highway 183 from Nichols Street to Decatur
Avenue .
DISCUSSION:
The City of Fort Worth has requested the Texas Department of Transportation (TxDOT) to contribute financial aid in the construction, maintenance,
and operation of the safety lighting systems within State Highway 183 from Nichols Street to Decatur Avenue. TXDOT has agreed to construct the
safety lighting system at its cost with the City assuming maintenance and operational obligations. Increases in maintenance costs are negligible as
this is new equipment and is not expected to malfunction over the initial lifecycle.
Staff agrees that the safety lighting system construction, maintenance, and operation division of responsibilities is fair and equitable.
A Form 1295 is not required because: This contract will be with a governmental entity, state agency or public institution of higher education: TxDOT
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that approval of these recommendation will have no material effect on City funds. Any assets donated as a result
of this agreement will be recorded in the City's financial records as appropriate.
