AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE STORMWATER CAPITAL PROJECTS FUND BY
INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
WESTCREEK CHANNEL MAINTENANCE PROJECT (CITY PROJECT
NO.103060) IN THE AMOUNT OF $200,000.00, AND BY DECREASING
ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE TOTAL CHANNEL
RESTORATION BOND PROGRAMMABLE PROJECT (CITY PROJECT NO.
P00136) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2022-2023 in the
Budget of the City Manager, there shall also be adjusted estimated receipts and appropriations in the
Stormwater Capital Projects Fund by increasing estimated receipts and appropriations in the Westcreek
Channel Maintenance project (City Project No. 103060) in the amount of $200,000.00, and decreasing
estimated receipts and appropriations in the Total Channel Restoration Bond programmable project (City
Project No. P00136) by the same amount.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of a contract with Humphrey & Morton Construction Company, Inc. in the amount of $2,301,070.00 for Westcreek
Channel Rehabilitation project (City Project No. 103060);
2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Stormwater Rev Bonds 2020 Fund by
increasing estimated receipts and appropriations in the Westcreek Channel Rehabilitation project (City Project No. 103060) in an amount
totaling $1,856,412.00, and decreasing estimated receipts and appropriations in 1) the Total Channel Restoration Bond programmable
project (City Project No. P00136) by $1,356,412.00 and 2) the Shore View Drive & Bomber Road HROM Construction project (City Project
No. 103051) by $500,000.00;
3. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Stormwater Capital Projects Fund by
increasing estimated receipts and appropriations in the Westcreek Channel Rehabilitation project (City Project No. 103060) in the amount of
$200,000.00, and decreasing estimated receipts and appropriations in the Total Channel Restoration Bond programmable project (City
Project No. P00136) by the same amount; and
4. Amend the Fiscal Years 2023-2027 Capital Improvement Program.
DISCUSSION:
Approval of this Mayor and Council Communication (M&C) will authorize execution of a construction contract with Humphrey & Morton Construction
Company, Inc. in the amount of $2,301,070.00 to stabilize and rehabilitate the concrete streambank side slope panels and stream beds of portions
of Westcreek Channel and Edgecliff Channel, between Altamesa Blvd and Westcreek Park, and Kraus Baker Channel, between McCart Ave and
Westcreek Drive.
The streambeds at these three locations have degradation and scour, leaving the concrete lined streambeds unstable and in need of rehabilitation.
The project will protect the existing public infrastructure in the area that is currently being threatened by the significant erosion and ensure the
channel continues to effectively convey stormwater runoff to mitigate flood risk. The project is an ongoing effort of the Stormwater Channel
Rehabilitation Program.
The project was advertised for bid in the Fort Worth Star -Telegram on November 10, 2022, and November 17, 2022. On December 15, 2022, the
following bids were received:

Construction is expected to begin in May 2023 and be completed by May 2024.
In addition to the contract amount, $225,437.00 is required for project management, material testing and inspection and $115,000.00 is provided
for project contingencies. The project is funded by 2020 Stormwater Utility Revenue Bonds and Stormwater Capital Projects fund. Funding is
being used from the Shore View Drive & Bomber Road HROM Construction project due to the project being completed under budget.
Funding for this project was included in the FY2023-2027 Capital Improvement Program in the amount of $1,500,000.00. Additional funding in the
amount of $1,856,412.00 is needed due to combining two additional channel projects to the Westcreek project. The action of this M&C will amend
the FY2023-2027 Capital Improvement Program as approved in connection with Ordinance 25773-09-2022.
DVIN OFFICE — Humphrey & Morton Construction Co., Inc. is in compliance with the City's Business Equity Ordinance by committing 26% MWBE
participation on this project. The City's MWBE goal on this project is 25%.
This project is located in Council District 6 / Future Council District 6
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Shore View & Bomber HROM project within the Stormwater Rev Bonds
2020 Fund and in the Total Channel Restoration Bond programmable project within the Stormwater Rev Bonds 2020 Fund and Stormwater Capital
Project Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in
the Stormwater Rev Bonds 2020 Fund and the Stormwater Capital Projects Fund for the Westcreek Channel Rehab project to support the
approval of the above recommendations and execution of the contract. Prior to any expenditure being incurred, the Transportation & Public Works
Department has the responsibility to validate the availability of funds.
