HomeMy WebLinkAboutOrdinance 26041-03-2023ORDINANCE NO.26041-03-2023 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SOLID WASTE FUND IN THE AMOUNT OF $88,940.00, FROM SALVAGE SALE PROCEEDS, FOR THE PURPOSE OF TRANSFERING TO THE SOLID WASTE CAPITAL PROJECT FUND FOR THE FUNDING OF MARTIN LUTER KING FENCE/GATE IMPROVEMENT PROJECT (CITY PROJECT NO. 104493); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2022-2023 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Solid Waste Fund in the amount of $88,940.00 from salvage sale proceeds for the purpose of transferring to the Solid Waste Capital Projects Fund for the Martin Luther King Fence/Gate Improvement project (City Project No. 104493). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. DISCUSSION: On January 9, 2023, City Council approved Mayor and Council Communication (M&C) 22-0980, appropriating funds in the Solid Waste Capital Projects Fund for the Martin Luther King (MLK) Fence/Gate Improvements Project as a result of the direct sale of two City -owned properties located at 4701 Village Creek Road and 5000 Martin Luther King Jr. Freeway, Fort Worth, Texas 76119 to the State of Texas — Texas Department of Transportation as necessary for the US Highway No. 287 (North) Construction Project. Sale proceeds in the amount of $88,940.00 will be used to relocate the existing fencing at 5000 Martin Luther King Jr. Freeway to allow for the planned expansion of the entrance ramp from Village Creek Road to US Highway No. US 287 and to improve the gate access to the facility. On June 28, 2022, City Council approved M&C 22-0510, authorizing the sale of the two properties and $88,940.00 in proceeds from the sale were errantly recorded to the General Capital Projects Fund PM City Fee Owned Property Sales Project instead of the Solid Waste Fund, as the property was identified on the survey as being a portion of land occupied by the Southeast Service Center. The proceeds have since been removed from the General Capital Projects Fund and recorded to the Solid Waste Fund. M&C 22-0980 adopted appropriations in the Solid Waste Capital Projects Fund for the MLK Fence/Gate Improvements Project. However, no appropriations were adopted to authorize the transfer of funding to the project. In order for funding to be transferred to the Solid Waste Capital Projects Fund, additional appropriations are required in the Solid Waste Fund. Funding is available for appropriation from available revenues within the Solid Waste Fund for the purpose of transferring to the Solid Waste Capital Projects Fund for the MLK Fence/Gate Improvement Project. This project is located in COUNCIL DISTRICT 5 / Future COUNCIL DISTRICT 11. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the Solid Waste Fund, and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the Solid Waste Capital Projects Fund for the MLK Fence/Gate Improv project. Prior to an expenditure being incurred, the Code Compliance Department has the responsibility of verifying the availability of funds.
