WHEREAS, The City of Fort Worth and Callahan & Freeman Architects (Consultant)
made and entered into City Secretary Contract No. 54172 (The Contract) which was
administratively authorized the 20th day of July, 2020, for Fort Worth Police
Department's South Patrol Division; and Amendment No. 1 was approved by M&C 20-
0549 in the amount of $262,600.00 for completion of Construction Drawings and
Construction Phase Service; and
WHEREAS, further amendment is necessary to reimburse the Consultant as part of the
design services agreement for additional services for an Oncor utility easement, and
construction administration services for extended construction schedule, value
engineering service, and structural redesign coordination of this project.
NOW THEREFORE, City and Consultant, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends the
Contract:
1.
Article I — Scope of Services, Paragraph (3) shall be added to read as follows:
(3) Provide additional professional services for the balance of the design and
construction administration of this project. The total cost of these additional
services is $78,290.00 plus $0.00 in reimbursable expenses. The scope of
services is described more fully in Attachments "B", "C", and "D".
2.
Article II — Compensation, first paragraph, is amended as follows:
"Consultant shall be compensated in accordance with the Fee Schedule shown
in Attachments "B", "C", and "D". Payment shall be considered full compensation
for all labor, materials, supplies, and equipment necessary to complete the
services described in Attachments "B", "C", and "D". However, the total fee
paid by the City shall not exceed a total of $425,890.00 unless the City
and the Consultant mutually agree upon a fee amount for additional services
and amend this Agreement accordingly."

Additional A-E Fee Request
Dear Alfonso:
As requested by the City of Fort Worth, Callahan & Freeman Architects has received a price proposal
from Baird, Hampton & Brown for survey services to document an easement on the southeast section of
the South Patrol Division site, to be dedicated to Oncor Electric Delivery Company. This easement is
required to accommodate electrical service to the new facility. Below is the fee requested.

It is our understanding that the City will prepare a contract amendment to add this service scope and
fee. Please let us know if anything is needed from us to support that process. Upon receipt of approval

Additional A-E Fee Request
Dear Alfonso:
Callahan & Freeman Architects (C&F) respectfully requests additional fee on the Fort Worth South
Patrol Division project. This request relates to additional design work due to the coordination of the
redesign of the structural systems, Contractor's value engineering items, and the extended time
frame of the project schedule.
I. Additional Scope Items
A. Structural coordination effort — Core Construction elected to redesign the structural systems
of the building including foundation, storm shelter, concrete wall panels, and steel building
framing. Adjustments to many of the architectural elements were necessary to integrate
with the new structural frame. Additional tasks included:
1. Coordinating column locations with the architectural plans.
2. Re -dimensioning of the floor plans to utilize the new structural grid dimensions.
3. Revisions to building sections and details to coordinate with the new beam and joist
sizes.
4. Reworking the lobby roof design,
B. Value Engineering effort — Core Construction priced the project repeatedly over many
months in an effort to reduce the cost. Industry wide cost increases, due to the global
pandemic, could not have been anticipated when the budget was set for this project. This
continued value engineering effort necessitated additional work from the design team
including making many changes to the plans and even reducing the overall size of the
building. As stated in a letter to Brian Glass, dated October 15, 2021 (copy attached), we
believe the design team should be compensated for this work.

Overall, the time from when plans were originally completed and submitted for permit
(April 26, 2021) till the construction commenced was 16 months. Pricing and value
engineering efforts continued through this time period. C&F posted 560 hours during this
"down time". We estimate that half of this time was on V.E. proposals, evaluations, and
assisting the Contractor in the repeated pricing efforts.
C. Extended project schedule — Per Article III of our Architectural Services Contract, additional
compensation is warranted if the project duration extends beyond 24 months. The Contract
was fully executed on July 20, 2020 (29 months ago). The current construction schedule
estimates a completion date of December 2023. This will result in an overall project term of
41 months (or 17 months beyond the contract term). Higher overhead and wage rates lead
us to request additional fee to cover the added cost.
II. Additional Fee breakdown
The additional fee requested for the above outlined services is as follows:
A. Structural redesign coordination
40 hours @ $150/hr.
B. Value Engineering
280 hours @ $150/hr.
C. Extended project schedule

Additional A-E Fee Request
Dear Mr. Glass:
At this point in the progress of the South Patrol Division project, with a bid from the Construction
Manager (CM) that is significantly higher than the budget, we believe it is necessary to agree on the
course of action required to complete the design for a successful development. We are committed
to this completion and we want to work for a strong result for the City of Fort Worth.
The process thus far has been delayed several times, caused by contractual decisions and a global
pandemic. That pandemic has also caused all prices in the world to escalate, creating a
construction market, the likes of which we cannot remember. The CM provided cost estimates at
50% and 9S%, which we believed to be accurate representations of the cost of the building as
documented at those stages of the design. At 95%, the cost was seen to be approximately
$1,000,000 over the target budget, and Callahan & Freemans Architects and engineering
consultants engaged with the CM to reduce cost through strategic changes in the design and the
selection of alternate materials and equipment. At the end of that process the design was validated
by the CM to be within the budget, with the City shifting some of the budget category totals to
increase the building portion to $12,700,000. The CM believed that this amount would be sufficient
to cover the final GMP based on 100% documents.
The status of the project at this time has a building cost from contractor bids that is $14,647,612,
almost 2-million dollars over the established budget. The industry cost increases could not have
been anticipated when the allocation of funds was decided for this project. It is clear from our
investigations that the original building program will need adjustments and significant design
changes will be needed to make the building match the budget in these current market conditions.
In light of these developments, C&F respectfully requests additional fee to revise the construction
documents. We can make the necessary changes and have already begun exploring the best ways
to alter the design to present to the City for confirmation and approval. We do believe, however,

that the design team should not be held responsible for the effects of the drastic changes in the
market conditions. When we have determined the scope of the changes necessary to make the
South Patrol Division project viable, we will provide a proposal for additional services fees for your
review and consideration. We understand that the additional A/E fees will have to be funded out of
the overall project budget, but they will be small compared to the construction cost savings this
process will realize. We look forward to finishing the process and to getting construction underway.
