ORDINANCE ACCEFTING IMPROVEMENTS ON A PORTION OF SYLVAIIIA AVENUE
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES
IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH
TEXAS BITULITHIC OMPANY FOR THE CONSTRUCTION OF SAID
IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE,
EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL
ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN
AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING
THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING
THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF
FORT WORTH, TEXAS, AND BY FILING TRE COMPLETE ORDINANCE IN APPRO-
PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract
with Texas Bitulithic Company for the making and construction of certain
street improvements on the hereinafter described portions of streets, avenues and
public places in said City, tc�,wit,,
SYLVANIA AVEM From the north line of NE. 28th Street
to the south line of NE. 36th Street,
known and designated as Unit 1p Project
No. 104-22000-138.

WHEREAS, by sundry proceedings heretofore passed by the City Council of the
"ity of Fort Werth, Texas, including Ordinance No, 5844 , a portion of the cast of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and against
the real and true owners thereof; and,
WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No. 5844 and
WHEREAS, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefor;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS, THAT-.
The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; .and the contract with
reference thereto be, and it is hereby, found and declared fully completed and performed,

The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments. The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed and shall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon. The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after giving
effect to such credit, if any, are hereby enumerated and itemized as follows-.
When each of the certifiactes has been duly executed as hereinabove provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City.
V.
This ordinance shall take effect and be in full force and effect from and after
the date of its passage.

This project was under construction for some 15 months because the contractor was
unable to execute the construction work in an orderly manner. After issuing the
work order to the contractor, 'Cone Star Gas Company decided to adjust both the
high pressure and the low pressure gas tarts between the railroad track and the
north limits of the project after utility clearance was given. American Manu-
facturing Company also delayed construction with the construction of a pedestrian
underpass after the paving work order had been issued. further, United Gas
Company was required to adjust a gas main which supplies American Manufacturing
Company, "there were also other minor adjustments of telephone and power poles
and a water meter, vault, all of which caused the contractor to drove off the
project on several, occasions resulting in unforeseen delays.

Proposed Change Order No. 7
Prior to beginning construction work on this project it was neces-
sary to maintain Sylvania Avenue while the utilities were bein=g
adjusted in the roadway. The contractor was instructed to per-
form all necessary maintenance on the street until such time as
actu=al construction could begin. This action, was taken, to
alleviate numerous complains relative to dust and chug holes
from the property owners near this project. The contractor,
Texas Bitulithip Co. , performed this maintenance and has sub-
mitted a gill of $2,057.55 for this work.

The plans for this project showed a storm sewer manhole to be
constructed n at Station° 22+81 w 38.- This manhole was not
includedri.'n the-proposal"in the contract, however, it was
necessary, to construct this manhole at the junction of the
storm drain pipe in accordance with the plans. The addi-
tional cost for building this manhole amounted to $450.00.

Proposed Change Order No. 8.
A meeting was held between "T"exas Bitulithic officials and
representatives of the City of Fort Worth relative to pro-
ceeding with paving a portion of Sylvania Avenue (from
28th Street to Chesser Boyer) . This was completed due to
several complaints received from 'property owners concerning
the excessive amount of dust, which in one instance was
interfering with a manufacturing operation. At this meeting
it was also determined that the section from Chesser Payer
Road to 36th Street would be paved at the same time with
only one move in operation, costing $2,000. After beginning
the paving from 28th to Chesser Boyer Road it was discovered
that the underpass being constructed by American Manufacturing
Company and the adjustment of the United Gas line serving
American Manufacturing Company would cause a delay of
approximately three weeks. Therefore, the contractor had to
move his equipment off the project and return it at a later
date. The contractor has made a claim for an additional
$4,0090 due to the second move-out and move-in.

Deviations from Bid Prices
Minor variations between quantities estimated in the contract documents and
quantities ,actually measured and used at the° job site resulted in an under-run
of $239.44.

During testing, on this project 28 corings were made with the following results.

On the entire project the average; thickness of the concrete paving is 7.75 inches
as compared to the 7.00 inches specified, and the average thickness of the lime
stabilized subg ade is 6.07 inches as compared to the 6.009 inches specified.

Tests made during construction of the subgrade and the pavement show that
materials used were in compliance, with,°specifications.
Recommendations:
It is recommended that:
1) Change Order Nos. 7 and, 8 be approved in the amount of $6,507.55; and
2) The above project be accepted by the adoption of an° ordinance and that
final payment of $20,307.04 "be authorized to Texas Bitulithic Company.
