Ordinance No. 1721409-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $412,969.54 AND THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $100,394.80 FROM AVAILABLE FUNDS FOR THE PURPOSE OF EXECUTING A CONTRACT WITH MCCLENDON CONSTRUCTION COMPANY, INC. FOR PAVEMENT RECONSTRUCTION AND WATER AND SANITARY SEWER REPLACEMENT ON BUNTING AVENUE, DOROTHY LANE AND ASHLAND AVENUE {PROJECT NUMBER 00166); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to thane amounts allocated to the various City departments fnr Fiscal Year 2005-2006 in the Budget of the City Manager,. there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $412,969.54 and the Sewer Capital Projects Fund in the amount of $100,394.80 from available funds for the purpose of executing a contract with McClendon Construction Company, Inc, far pavement Reconstruction and Water and Sanitary Sewer Replacement on Bunting Avenue, Dorothy Lane and Ashland Avenue {Project Number 00166). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void far any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the transfer of $513,364.34 from the Water and Sewer Operating Fund to the Water Capital Projects Fund in the amount of $412,969.54 and Sewer Capita! Projects Fund in the amount of $100,394.80; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $412,969.54 and the Sewer Capital Projects Fund in the amount of $100,394.80, from available funds; and 3. Authorize the City Manager to execute a contract with McClendon Construction Company, Inc., in the amount of $1,399,414.30 for Pavement Reconstruction and Water and Sanitary Sewer Replacement on Bunting Avenue {Bertrose Avenue tv Washington Terrace), Dorothy Lane (West 7th Street to Clarke Avenue) and Ashland Avenue {Crestline Road to Camp Bowie Boulevard). DISCUSSI®N: On June 2S, 2005, (M&C C-20816} the City Council authorized the City Manager to execute an engineering agreement with Teague, Nall and Perkins, lnc., for the design of portions of Bunting Avenue and Dorothy Lane and Ashland Avenue (DOE 4875}, which consists of pavement reconstruction. The 2004 Capital Improvement Program (CIP} includes funds for pavement reconstruction on Bunting Avenue (Bertrose Avenue to Washington Terrace), Dorothy Lane {West 7th Street to Clarke Avenue} and Ashland Avenue (Crestline Road to Camp Bowie Boulevard). Street improvements include pavement reconstruction, construction of standard concrete curb and gutter, driveway approaches and sidewalks as indicated an the plans. The Water Department has determined that severely deteriorated water and sanitary sewer lines should be replaced prior to street reconstruction. The project was advertised for bid on June 15 and 22, 2006. On July 13, 2006, the following bids were received: Bidders Alternate "A" Alternate"B" (Concrete} ~As~hal~ McClendon Construction Company, loc. $1,359,414.30 No Bid Lagname: 30BUNTING00166 Page 1 a£ 3 JLB Contracting, Inc_ $1,419,616.95 Na Bid Ed A. Bids were solicited on two alternates: e Alternate "A" consists of a 6-inch concrete pavement aver 6-inch lime stabilized subgrade with 7-inch concrete curb. ® Alternate "B" consists of a 6-inch hot mix asphalt concrete {HMAC} pavement aver 8-inch Time stabilized subgrade with 7-inch concrete curb and 18-inch gutter. Bids received consisted of only Alternate "A" the reinforced concrete pavemenfi. Staff recommends the construction of the streets with reinforced concrete pavement. Funding in the amount of $43,219.89 is included far associated water and sewer project management, construction survey, material testing, inspection and project close out (water $34,386.54; and sewer: $8,833.35). The contingency funds to cover change orders fatal $24,027.00 (water: $18,027.00; and sewer: $6,OOOAD). Funding in the amount of $88,919.56 is required far associated paving and drainage construction survey, project management, pre-construction, material testing, inspection and project close out. The contingency fund for possible change orders for paving and drainage improvements is $28, 598.00. MNVBE -McClendon Construction Company, Inc., is in compliance with the City's MNVBE Ordinance by committing to 10 percent MIWBE participation and documenting good faith effort on this combined project. The City's M/VI/BE goal on this combined project is 27 percent. This project is located in COUNCIL DISTRICT 7 Mapsco 75C, D and G. FISCAL. IIVFOFiMATIONICIrRTIFICATION: The Finance Director certifies that upon approval of the above recommendations, and adoption of the attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, of the Water Capital Projects Fund, the Sewer Capital Projects Fund and the Street Improvements Fund.
