AN ORDINANCE PRESCRIBING APPLICATION FEES TO BE CHARGED BY THE ZONING BOARD OF ADJUSTMENT AND THE PLAN COMMISSION AND BY THE ZONING COMMISSION FOR DOCKETING ZONING PETITIONS; AND PRESCRIBING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. For services rendered, the following schedule of fees and charges are hereby adopted: Application Fees Zoning Board of Adjustment For Church Site Plans, Interpretations, owner-Occupied - Residence Variances $ 25.00 Variance Appeals, Auxiliary Parking Exceptions 50.00 other Special Exceptions 100.00 Plan Commission Preliminary Plans 25.00 Base + $1.00 per acre Final Plat 25.00 Base for first 5 lots + 50�4_ for each addi- tional lot Short Form Plat 25.00 Base for first 5 lots + 50¢ for each addi- tional lot Right-of-way Vacations 100.00 Easement Vacations 50.00 Zoning Commission Applications for zoning changes 100.00 plus actual cost of publication of metes and bounds descrip- tion, if any SECTION 2. No final approval of a plat shall be given by the Plan Commission of the city of Fort Worth unless and until a receipt is furnished the Secretary of said Commission showing that the fee provided for in this ordinance has been paid; no petition shall be docketed with the Zoning Commission of the City of Fort Worth unless and until a receipt has been furnished to the Secretary of said Commission showing that the fee provided for in this ordinance has been paid; and no application for relief shall be docketed with the Board of Adjustment of the City of Fort Worth unless and until a receipt is furnished the Secretary of said Board showing that the fee provided for in this ordinance has been paid. SECTION 3. That this ordinance shall take effect and be in full force and effect from and after the 29th day of August, 1969. City of Fort Worth, Texas Mayor and Council Communication , DATE REUFERENCE SUBJECT; PAGE 0 A MSER 8/11/69 Application Fees The Application Section of the Planning Department handles all applications and dockets for the City Plan Commission, the Zoning Commission, and the Board of Adjustment. This function requires the services of ten people, and a budget of $85,935. Some of the services provided directly benefit the general public but others are for the unique and special benefit of the applicant with little bene- fit being derived by the general public. The fees provided for these services were established by Ordinance No. 3747 in January of 1958, and are not representative of today's cost involved in processing the applications. Cost Study The Planning staff has recently completed an analysis of the average cost of handling each type of application. Based on this study, it is proposed that all fees be raised to more nearly recover the cost of handling the case, but with weight given to hardship and to the benefits to be derived by the public at large. The following table summarizes the existing fee, the proposed fee, comparison with Dallas and Arlington, and the actual cost of processing a case by the Application Section. Staff time required of other City Departments is not included in the cost calculation. Estimated Revenues - Under the current fee schedule the estimated revenues for fiscal year 1968-69 is $11,600. The projected revenue for fiscal year 1969-70 (based on the proposed fee schedule) is $42,789. Recommendation It is recommended that an ordinance be adopted amending Ordinance No. 3747 by adopting the fee schedule recommended above, and that such Fee Schedule be effective for applications received after the close of business on August 29, 1969.
