HomeMy WebLinkAboutOrdinance 17215-09-2006ordinance Na. 9 72 1 5-09-2a06 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $367,161.67 AND THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $59,629 FROM AVAILABLE FUNDS 1=0R THE PURPOSE OF EXECUTING A CONTRACT WITH CONATSER CONSTRUCTION TX, LP, FOR PAVEMENT RECONSTRUCTION AND WATER AND SANITARY SEWER REPLACEMENT ON CHILDRESS STREET, EASTI-AND STREET, GRAYSON STREET AND CUTTER STREET; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVib1NG AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2005-2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $367,161.67 and the Sewer Capital Projects Fund in the amount of $09,829 from available funds for the purpose of executing a contract with Conatser Construction TX, LP, far Pavement Reconstruction and Water and Sanitary Sewer Replacement on Childress Street, Eastland Street, Grayson Street and Cutter Street. SECTION 2. That should any portion, section ar part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and off other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said canfficting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. Authorize the transfer of $426,790.67 from the Water and Sewer Operating Fund to the Water Capital Projects Fund in the amount of $367,161.67 and Sewer Capital Projects Fund in the amount of $59,629.00; 2. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $367,161.67 and the Sewer Capital PrajeGts Fund in the amount of $59,629.00, from available funds; and 3. Authorize the Cify Manager to execute a Contract with Conatser Construction TX, LP, in the amount of $1,457,223.00 for Pavement Reconstruction and Water and Sanitary Sewer Replacement an Childress Street (Wichita Street to Erath Street), Eastland Street {Wichita Street to Nolan Street), Grayson Street (Wichita Street to Foard Street) and Cutter Street (Foard Street to !Nolan Street). D6SCt1SSION. On October 12, 2004 (M&C C-20333), the City Council authorized the City Manager to execute an engineering agreement with Carter & Burgess, Inc., far the design of portions of Childress Street, Eastland Street, Grayson S#reet and Cutter Street (DOE 4580), which consists of pavement reconstruction. The 2004 Capital Improvemenfi Program (CIP) includes funds for pavement reconstruction on all streets mentioned above. Street improvements include pavement reconstruction, construction of standard Concrete Gurb, driveway approaches and sidewalks as indicated on the plans. The Water Department has determined that severely deteriorated water and sanitary sewer lines should be replaced prior to street reconstruction. The project was advertised for bid nn June 8 and 15, 2006. On July 20, 2006, the following bids were received: Bidder Conatser Construction TX,LP Stabile & Winn, Inc. Bids were solicited on two alternates: ® Alternate "A" consists of a six-inch concrete pavement over six-inch lime stabilized subgrade with seven-inch concrete curb. ® Alternate "B" consists of a six-inch hot mix asphalt concrete (HMAC) pavement over eight-inch lime stabilized subgrade with seven-inch concrete curb and 18-inch gutter. Bids received consisted of only Alternate "A" the reinforced concrete pavement. Staff recommends the construction of the streets with reinforced concrete pavement. Funding in the amount of $33,529.57 is included far associated water and sewer project management, construction survey, material testing and inspection {water $28,603.67 and sewer $4,926.00 ). The contingency funds to cover change orders total $ 21,094A0 (water $16,921.00 and sewer $4,973.x0 }. Funding in the amount of $109,308.00 is required for associated paving and drainage construction survey, project management, pre-construction, material testing, inspection and project close out. The contingency fund for possible change orders far paving and drainage improvements is $32,552.00. MIWBE -- Conatser Construction TX, LP is in compliance with the City's MIWBE Ordinance by committing to nine percent M/WBE participation and documenting goad faith effort on this combined project. Conatser Construction TX, LP, identifed several subcontracting opportunities. However, the MIWBE's contacted in the areas identified did not respond or did not submit the lowest bids. The City's MIWBE goal on this project is 28 percent. This project is located in COUNCIL DISTRICT 8 Mapsco .78X and Y, 92B, C and F. FISCAL INFORMATIONICERTIFICATION: The Finance Director certifies that upon approval of the above recommendations, and adoption of the attached appropriation ordinance, funds will be available in thecurrent capita! budgets, as appropriated, of the Water Capital Projects Fund, the Sewer Capital Projects Fund and the Street Improvements Fund.
