DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is, as an Owner City of Dallas Fort Worth International Airport (DFW) to authorize the conveyance of a Pedestrian Access Easement on property located at DFW to the City of Fort Worth (City) for the CentrePort Trail Phase Project and allow the City Manager to execute and record the appropriate instruments as well as to authorize the acceptance of such Pedestrian Access Easement to the City. The City Council approved an Advanced Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) in the amount of $2,757,588.00 on June 20, 2017 (M&C G-18975 and M&C G-19040) for the engineering and construction of the CentrePort Trail Phase I between American Airlines Headquarters at Trinity Boulevard and THE CentrePort Station (approximately 1.6 miles total). On September 25, 2018, the City Council approved Amendment No. 1 to increase the total agreement amount from $2,757,588.00 to $3,684,450.00 (M&C G-19383) for additional engineering scope of the CentrePort Trail Phase II (approximately 3.5 miles total). On June 14, 2022, the City Council approved Amendment No. 2 to increase total agreement amount from $3,684,450.00 to $6,396,749.00 (M&C 22-0405) for an increase in the estimated cost of constructing the CentrePort Trail Phase I. Anticipated improvements include a 12-foot wide concrete paved trail, 2-foot wide shoulder on both sides of the trail and related retaining wall and stormwater structures. As a part of the trail construction, a 30-foot wide permanent pedestrian trail easement is needed to be dedicated to the City for this project for a parcel on DFW Airport. This M&C authorizes the City, as one of the owner -cities under the 1968 Contract and Agreement which formed DFW between the City of Dallas and the City (Agreement) to convey the necessary easement rights to the City for the Pedestrian Access Easement discussed above. of land currently leased by American Airlines, Inc. for 99 years. The City has executed a Pedestrian Access License Agreement with American Airlines, Inc. on January 21, 2021 (CSC No. 55232) for the access and use of temporary construction easement and 30-foot wide permanent pedestrian trail easement however because this project is being grant funded, the City needs an actual easement property right for the tract. The DFW International Airport Board (Airport Board) originally approved and authorized for the pedestrian access easement rights on May 12, 2022, via Official Board Resolution No. 2022-05-108. Both state law and the Agreement require that all real property transactions must be approved by the City Council of both owner cities.
