AN ORDINANCE DECREASING THE ABNORMAL SEWAGE
SURCHARGE PAYABLE BY PERSONS GENERATING AND
DISCHARGING ABNORMAL SEWAGE INTO THE CITY'S
SANITARY SEWERAGE SYSTEM BY AMENDING SUB-
SECTION (b) ABNORMAL SEWAGE SURCHARGE OF
SUBPARAGRAPH 4. PRETREATMENT AND SURCHARGE
OF SECTION 29-113 OF CHAPTER 29 OF THE FORT
WORTH CITY CODE (1964) , MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES AND PROVISIONS OF THE FORT WORTH
CITY CODE IN CONFLICT HEREWITH; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A PENALTY; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Subsection (b) Abnormal Sewage Surcharge of Subparagraph
4. PRETREATMENT AND SURCHARGE of section 29-113 of Chapter 29 of
the Fort Worth City Code (1964) is hereby amended and, after hav-
ing been so amended, shall hereafter read as follows;
11 (b) Abnormal Sewage Surcharge: Persons gener-
ating Abnormal Sewage may discharge such
sewage into the sanitary sewer provided:
(1) the waste will not cause damage to the
collection system, (2) the waste will not
impair the treatment processes, (3) the
person discharging such waste pays a monthly
surcharge to the Fort Worth Water Department
in addition to the usual monthly sewer service
charges. Computations of such surcharges shall
be based on the following formula:
S=Vx62.4x[0.011 (B.O.D.-300)+0.007 (S.S.-300) ]
S = surcharge in dollars
v = water consumption in millions of
cubic feet during the billing period
62.4 = pounds per cubic foot of water
0.011 = unit charge per pound for B.O.D.
in dollars
B.O.D. = B.O.D. strength index in parts
per million by weight
300 = normal B.O.D. strength in parts
per million by weight
0.007 = unit charge per pound for sus-
pended solids in dollars
S.S. = suspended solids strength index in
parts per million by weight
300 = normal suspended solids strength
in parts per million by weight
Abnormal sewage surcharges payable under
this paragraph shall be as follows:
Commencing January 1, 1970, 20 percent of
charges computed by formula.
Commencing October 1, 1970, 60 percent of
charges computed by formula.
Commencing October 1, 1971, 100 percent of
charges computed by formula.
If the strength index for either B.O.D. or
S.S. is less than the normal strength index
for that category, then there shall be no
surcharge for that category, nor shall there
be credit given to the total surcharge. "
SECTION 2.
That this ordinance shall repeal every prior ordinance and
provision of the Fort Worth City Code in conflict herewith but
only insofar as the portion of such prior ordinance or provi-
sion shall be in conflict, and as to all other ordinances or
provisions of the Fort Worth City Code not in direct conflict
herewith, this ordinance shall be and is hereby made cumulative.
SECTION 3.
That if any section, part of a section or provision of any
section of this ordinance shall be held to be void, ineffective
or unconstitutional by a court of competent jurisdiction, the
holding of such section, part of a section or provision of any
section to be void, ineffective or unconstitutional for any
cause whatsoever shall in no way affect the validity of the re-
maining sections and provisions of this ordinance, which shall

remain in full force and effect. The City Council would not
have passed any sections, parts of sections or provisions of
any section of this ordinance that were unconstitutional, void
or ineffective if it had known that they were unconstitutional,
void or ineffective at the time of adopting this ordinance.
SECTION 4.
That the violation of any provision of this ordinance or
of the Fort Worth City Code relating to the pretreatment, dis-
position or discharge of waste into any public sewer or the
payment of an Abnormal Sewage Surcharge shall be deemed an of-
fense and punishable by a fine not exceeding Two Hundred Dollars
($200) , and each violation thereof, and each day on which there
is a failure to comply with the terms of this ordinance shall
be and is hereby deemed to be a distinct and separate offense
and punishable as such.
SECTION 5.
That this ordinance shall be in full force and effect from
and after its passage and publication as required by law.

On October 27, 1969 (M&C G-1450), the City Council adopted Ordinance No.
6185 establishing an industrial waste surcharge. The surcharge was
effective on January 1, 1970, based on 33 per cent of the charge computed
by using the formula defined in the ordinance. The computed charge will
increase to 66 per cent of the formula starting October 1, 1970, and, to
100 per cent starting October 1, 1971
The only serious objections received by the Water Department staff regarding
the surcharge Ordinance have related to the January I effective date and
the initial rate. Several. industry representatives have objected to the
relatively brief notification period and the beginning rate of 33 pet cent.
The effective date of January 1, 1,970, is *considered by the staff to be
reasonable, especially since the surcharge will not be payable until bills
are received in February. Therefore, it is recommended that the January 1
effective date be retained. However, so that no undue hardship will be
incurred on some industrial customers, it is recommended that the initial
charge be computed at 20 per cent of the applicable formula instead of 33
per cent, and the rate effective October 1, 1970, be reduced to 60 per
cent instead of 66 per cent as originally approved by the City Council.
The proposed amendment to Ordinance No. 6185 provides as follows:
Commencing January 1, 1970, 20 per cent of
charges computed by formula.
Commencing October I, 1970, 60 per cent of
charges computed by formula.
Commencing October 1, 1971, IGO per cent of
charges computed by formula.
Recommendation I
It is recomiended that the amendment to Ordinance No. 61,85 be approved.
