Ordinance No. 17218-09-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER CAPITAL PROJECTS FUND fN THE AMOUNT OF $54,560 FROM AVAILABLE 1=UNDS FOR THE PURPOSE OF EXECUTING AMENDMENT NUMBER 11 TO CITY SECRETARY CONTRACT NUMBER 27560 (M&C C-19049) WITH RUNAWAY ASSOCIATES, L.P. FOR SANITARY SEWER REHABILITATION CONTRACT LV {55); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLlGT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments far Fiscal Year 2005- 2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of $54,560 from available funds for the purpose of executing Amendment Number 11 to City Secretary Contract Number 27560 {M&C C-19049) with Dunaway Associates, L. P., for Sanitary Sewer Rehabilitation Contract LV (55). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative ar void far any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, ar parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and ail other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed_ SECTION 4. Authorize the transfer of $54,560.00 from the Water and Sewer Operating Fund to the Sewer Capital Projects Fund; 2. Adopt the attached apprnpriatinn ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of $54,560.00 from available funds; and 3. Authorize the City Manager to execute Amendment No. 11 to City Secretary Contract No. 27650 with Dunaway Associates, L.P., in the amount of $54,560.00 to provide additional engineering services, thereby increasing the contract amount to $751,862.82. DISCUSSION: On April 16, 2002, (M&C C-19049} the City Council authorized an engineering agreement with Dunaway Associates, 1"...P., in the amount of $315,790.12 far Sanitary Sewer Rehabilitation Contract l_V {55}. The agreement was subsequently revised by ten previous amendments totaling $381,247.30 as follows: • Amendment No. 1 in the amount of $86,307.50 {M&C C-19436, January 21, 2003} provided additional engineering services fnr the replacement of a severely deteriorated sewer line in close proximity to the project area. • Amendment No. 2 in the amount of $22,270.00 and administratively approved by the City Manager on May 27, 2003, allowed for design far the rerouting of a conflicting storm drain system. • Amendment No. 3 in the amount of $123,659.30 (M&C C-19871, December 2, 2003) provided for additions[ engineering services for the rerouting of several deteriorated sewer iines in close proximity to the project area. • Amendment No. 4 in the amount of $24,865.90 and administratively approved by the City Manager an March 26, 2004, allowed for the design of a new alignment far a deteriorated and blocked sewer main in close proximity to the project area. • Amendment No. 5 in the amount of $24,682.60 and administratively approved by the City Manager nn May 26, 2004, provided additional engineering services for the Logname: 30LV5511DUNAWAY Page 1 oft replacement of additional deteriorated sewer mains in close proximity to the project area. • Amendment No. 6 in the amount of $24,000.00 and administratively approved by the City Manager on December 15, 2004, allowed for the redesign ofi a sewer main in the Part 1 plans to accommodate the Sierra Vista development. Amendment No. 7 in the amount of $12,674.00 and administratively approved by the City Manager on January 13, 2005, allowed the redesign of the Part 2 plans to incorporate the sewer main for the Sierra Vista development. • Amendment No. 8 in the amount of $24,674.00 and administratively approved by the City Manager nn February 9, 2005, allowed the Part 1 plans to be divided into three units in order to expedite construction of the project. • Amendment No. 9 in the amount of $24,880.00 and administratively approved by the City Manager on July 28, 2005, provided for revisions to the project plans to accommodate recent changes to the sewer main within the Sierra Vista subdivision. • Amendment No. 10 in the amount of $13,50Q00 and administratively approved by the City Manager an August 18, 2005, provided for the redesign of a 1,500 feet segment of a project sewer main to accommodate other, proposed development. Amendment No. 11 will provide compensation for the following: Revisions to the plans to allow a segment of the project sewer main to be constructed in conjunction with the proposed water, sewer paving and drainage improvements within the Sierra Vista subdivision; additional caardination efforts; additional expense incurred for plan and specification reproduction beyond the original scope; additional construction assistance; revisions to the storm water pollution prevention plan and the preparation of "as-built" drawings for the project. Dunaway Associates, t_.P., proposes to provide the necessary additional design and survey services for a fee of $54,560.00. Staff considers this amount to be fair and reasonable. Dunaway Associates, L.P. is in compliance with the City`s MIWBI~ Ordinance by committing to an additional seven percent M/WBE participation an this AmendmentlChange Order No. 11. The City's goal on this amendment change order ar extra work is seven percent.
