HomeMy WebLinkAboutOrdinance 6440 ^ - � ORDINANCE N0. ���,2~,V�/ AN ORDINANCE MAKING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 0.0148 SQUARE MILES, MORE OR LESS, OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA SHARE OF TAXES; PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL OF THE PRIVILEGES OF ALL THE CITIZENS OF FORT WORTH, TEXAS/ PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be beard on the proposed annexation of the territory hereinafter described, was held at the City Council Chamber in the City Hall ofFort Worth, Texas, on the 15th day of February 1971, which date is not more than twenty (20) nor less than ten (lO) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published in a newspaper having general circulation in the City of Fort Worth, Texas, and in the hereinafter described territory on the 2nd day of February 1971, which date is not more than twenty (20) nor less than ten (lU) days prior to the date of such public hearing; and WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 376,000 inhabitants; and WHEREAS, the corporate area of the City of Fort North, Texas was 212'5 square miles on January l, 1071; and WHEREAS, the hereinafter described territory lies within the extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the territory hereinafter described contains approximately 0'0148 square miles; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION l. That the following described land and territory located approximately 9 miles north of the Tarrant County Court House, lying � . ` ° adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory herein- after described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the present boundary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to wit: TRACT 1. Being a tract of land approximately 9 miles north of the Court House of Tarrant County, Texas, and located in the William Redfield Survey Abstract 1348, more fully described as follows. BEGINNING at a point in the south right-of-way line of County Road No. 4006 (Hicks Road), said point being 500 feet northeasterly, measured at right angles, of the northeasterly right-of-way line of U.S. Highway 81-287; Thence continuing east along the south line of said County Road 4005 to a point for corner, said point being 1210 feet M/L east of the northeasterly right-of-way line of U.S. Highway 81-287, and also being the northeast corner of a tract of land containing 19 acres M/L owned by the Texas Livestock, Marketing Association; thence south along a straight line, said line being the east boundary of the 19 acre tract, to a point for corner, said point being 500 feet northeasterly, measured at right angles, of the northeasterly right-of-way line of U.S. Highway 81-287; Thence northwesterly along a line 500 feet northeast- erly of and parallel to the northeasterly right-of-way line of said Highway 81-287, to the point of beginning; and containing 6.2 acres M/L. TRACT 2. Being a tract of land approximately 9 miles north of the Court House of Tarrant County, Texas, and located in the J. Walker Survey Abstract 1600, more fully described as follows: BEGINNING at a point 500 feet northeasterly of the northeasterly right-of-way line, measured at right angles, of U.S. Highway 81-287, said point also being in the north line of a 15.4 acre tract of land conveyed by T.B. Hart to Allen Blair, Don Chambless, Bob O'Dell, Dun Norris, (Vista Industries), February ll, 1964, and recorded on Page 4682, Volume 351, Deed Records of Tarrant County, Texas; Thence east along said north line of said 15,4 acre tract, and said line projected east to the west right-of-way line of County Road No. 4105; Thence south along the west line of said Road 4105 to a point for corner, said point being 600 feet northeasterly, measured at right angles, of the northeasterly right-of-way line of U.S. Highway 81-287; Thence northwesterly along a line 500 feet from and parallel to the northeasterly line of said Highway 81-287 to the point of beginning; and containing 4.3 acres M/L. -2- SECTION 2. The foregoing-described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata share of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. SECTION 3. That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumulative. SECTION 4, If any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional, by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases, or words except as the same are inseparable from and indispensable to the remaining portions of the ordinance. SECTION 5. This ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained.
