ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF BRENTw D STAIR ROAD AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT ti40RTH, TEXAS; DECLARING THE CONTRACT WITH. S_R_O. ASPHALT, INC. , ARLINGTON, TEXAS FOR THE CONSTRUCTION OF SAID IMPROVffENTS FULLY COIAPLETED AND PERFORME4D; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESS MENTS LEVIED AFTER GIVING EFFECT TO SU14DRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAIN T 301-E OF SAID ASSESSMENTS, DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAP- TION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE OHDINA14CE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. 'WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract withs.R.O. ASPHALT, INC. , ARLINGTON, TEXAS for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: UNIT 1• BRENIVOOD STAIR ROAD From 427' west of Terbet Lane to 1181 east of Terbet Lane, known and designated as Unit 1, Project No. 104-24000-203. UNIT 2: TERBET LANE From Brentwood Stair Road to 570' north, known and designated as Unit 2, Project No. 104-24000-203. UNIT 3- SHERATON LANE (DELETED) UNIT 4• GLEN GARDEN DRIVE From Beverly Avenue to Riverside Drive, known and designated as Unit 4, Project No. 104-24000-203. WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. ALI , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 6271 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT,. Io The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; .and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. The Mayor, be, and he is hereby, directed to issue and execute in the name cf the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance' with the proceedings relating to such improvements and assessments, The certificates shall be numbered, shall describe the property against which the asses'sment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows,. When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. N. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Deviation from Bid Price: The final cost of this project is $5,625.49 less than the revised contract price. Approximately $3,600 was saved since a metal pipe subdrain was not required as originally anticipated. The remainder of the cost difference, $2,025.49 is attributed to minor va,ri- ations between quantities estimated in the contract documents and quantities actually measured and used at the job site. Exceeds Even with Under Specs but Below !Pecs Vithin Tolerance Tolerance The area adjacent to the core shown as below tolerance was subsequently over- laid with an additional one and one half inches of HKAQ This overlay changed the average thickness in the deficient area from 6.26 inches to 7. 76 inches. On Unit 4 the average thickness of the INAC paving is 7.04 inches as compared to the 7.00 inches specified, and the average thickness of the lime stabilized sub-grade is 6.08 inches as compared to the 6.00 inches specified. Tests made during construction show that materials used were in compliance with contract Recommendations It is recommended that the project described above be accepted by the adoption of an ordinance and that final payment of $10, 118.68 be authorized to SRO Asphalt, Inc.
