Ordinance No. 17220-09-2006 AN ORDINANCE INCREASING ESTIMATI=D RECEIPTS AND APPROPRIATIONS iN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $254,235 AND THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $429,366.37 FROM AVAILABLE FUNDS FOR THE PURPOSE OF EXECUTING A CONTRACT WITH CONATSER CONSTRUCTION TX, LP FOR PAVEMENT RECONSTRUCTION AND WATER AND SANITARY SEWER MAIN REPLACEMENT ON MALINDA LANE NORTH (JENSON ROAb TO MALINDA LANE SOUTH), MALINDA LANE SOUTH (MALINDA LANE NORTH TO JENSON ROAD} AND MARTHA LANE (MILAM STREET TO BARRON LANE); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE. CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: 81=CTION 9. That in addition to those amounts allocated to the various City deparkments fnr Fiscal Year 2005-2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $254,235 and the Sewer Capital Projects Fund in the amount of $429,366.37 from available funds far the purpose of executing a contract with Conatser Construction TX, LP far Pavement Reconstruction and Water and Sanitary Sewer Main Replacement on Malinda Lane North (Jenson Road to Malinda Lane South), Maiinda Lane South (Malinda Lane North to Jenson Road) and Martha Lane (Milam Street Barron Lane). SECTION 2. That should any portion, section ar part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, SBGtIQ€1S, or parts of sections of this ordinance, which said remaining provisions shall be and remain in foil force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance Na. 16582 and all other ordinances and appropriations amending the same except in thane instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. Authorize the transfer of $683,601.37 from the Water and Sewer Operating Fund to the Water Capital Projects Fund in the amount of $254,235.DD and Sewer Capita! Projects Fund in the amount of $429, 366.37; 2. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $254,235.00 and the Sewer Capital Projects Fund in the amount of $429,366.37, from available funds; and 3. Authorize the City Manager to execute a contract with Conatser Construction TX, LP, in the amount of $1,493,a71.5D for Pavement Reconstruction and Water and Sanitary Sewer Main Replacement on Malinda Lane North {Jenson Road to Malinda Lane South), Malinda Lane South {Malinda Lane North to Jenson Road) and Martha Lane {Milani Street to Barron Lane). DISCUSSION. The 2004 Capital Improvement Program (CIP) includes funds for pavement reconstruction an all streets mentioned above. Street improvements include pavement reconstruction, construction of standard concrete curb and driveway approaches as indicated an the plans. The Water Department has determined that severely deteriorated water and sanitary sewer lines should be replaced prior In street reconstruction. On June 28, 2005, (M&C C-20822) the City Council authorized the City Manager to execute an engineering agreement with LnpezGarcia Group, Inc., for Pavement Reconstruction and Water and Sanitary Sewer Main Replacement on Malinda Lane North (Jenson Road to Malinda Lane South), Malinda Lane South (Malinda Lane North to Jenson Road} and Martha Lane (Milani Street to Barron Lane}. (DOE 4879) The project was advertised on June 22, 2DD6 and June 29, 2DD6. Funding in the amount of $35,586.37 is included for associated water and sewer construction survey, project management, pre-construction, material testing, inspection and project close out (water $18,330.00 and sewer $17,236.37). The contingency funds to cover change orders total $30,859.00 (water $11,234.00 and sewer $19,625.00). Funding in the amount of $54,852.01 is required for associated paving and drainage construction survey, project management, pre construction, material testing, inspection and project close out. Contingency for pavement reconstruction is $43,820.00. MIWBE -Conatser Construction TX, LP, is in compliance with the City's M/W8E Ordinance by committing to 11 percent MIWB participation and documenting goad faith effort. Conatser Construction, LP, identfied several subcontracting and supplier nppartunities. However, the MIlNBE's contacted in the areas identfied did not submit the lowest bids. The City's goal on this project is 22 percent, This project is located in COUNCIL DISTRICT 4, Mapsco 79B and 808. FISCAL INFORMATIONICERTIFICATION: The Finance Director certifies that upon approval and completion of recommendation 1, and the adoption of the attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, of the Water Capital Projects Fund, the Sewer Capital Projects Fund and the Street Improvements Fund.
