HomeMy WebLinkAboutOrdinance 6639 W 11,00 ORDINANCE NO, AN ORDINANCE PROVIDING FOR THE PROTECTION OF PERSONAL PROPERTY AGAINST THEFT BY CREATING A POLICE IDENTIFICATION NUMBER KEEPER REGISTER, MAKING IT UNLAWFUL TO ERASE, DEFACE OR ALTER A POLICE IDENTIFICATION NUMBER WHICH HAS BEEN INSCRIBED OR ATTACHED TO AN ARTICLE OF PER- SONAL PROPERTY; MAKING IT UNLAWFUL TO POSSESS AN ITEM OF PERSONAL PROPERTY ON WHICH THE POLICE IDENTIFICATION NUMBER HAS BEEN ERASED, DEFACED OR ALTERED; PROVIDING PENALTIES; PRO- VIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: SECTION 1, There is hereby created a police identification number keeper register which shall be maintained by the Police De- partment of the City of Fort Worth for the purpose of regis- tering and recording identification numbers which have been assigned by the Police Department to private individuals or businesses in the City of Fort Worth for use in identifying their articles of personal property for protection against loss, theft or burglary and as a means of identification and recovery of such items if lost or stolen. Participation in the police identification number keeper program shall be on a voluntary basis and at the option of the citizen. SECTION 2. As used in this ordinance the term "Police Identification Number" shall mean a number or a combination of digits and letters which has been assigned by the Police Department of the City of Fort Worth to a particular person or business for the purpose of identifying articles of personal property, which number shall have been recorded and registered in the police identification number keeper register, and which has been permanently inscribed, etched, affixed or attached to an item of personal property by the owner for the purpose of identifying same. SECTION 3. It shall be unlawful for any person to alter, change, deface, erase or mutilate, for the purpose and intent of changing the identity, any police identification number which has been permanently inscribed, etched, affixed or attached to any article of personal property by the owner for the purpose of identification. It shall also be unlawful for any person to have in his possession any article of personal property, knowing that the police identification number placed on same by the owner for the purpose and intent of identification has been altered, changed, defaced, erased or mutilated, for the purpose and intent of changing the identity of said article of personal property. SECTION 4. Any person, firm, corporation, associations of persons or any agent or employee thereof who violates any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and., upon conviction thereof, shall be fined not to exceed $200.00 for each offense. Each day of viola- tion shall constitute a separate offense. SECTION 5. This ordinance shall repeal every prior ordinance in conflict herewith, but only insofar as the portion of such prior ordinance shall be in conflict, and as to all other sections of ordinances not in direct conflict herewith, 2 /0 this ordinance shall be and is hereby made cumulative. SECTION 6. That if any section, part of a section or provision of any section of this ordinance shall be held to be void, ineffective or unconstitutional by a court of competent jurisdiction, the holding of such section, part of a sec- tion or provision of any section to be void, ineffective or unconstitutional for any cause whatsoever shall in no way affect the validity of the remaining sections and pro- visions of this ordinance, which shall remain in full force and effect. The City Council would not have passed any sections, parts of sections or provisions of any section of this ordinance that were unconstitutional, void or in- effective if it had known that they were unconstitutional, void or ineffective at the time of adopting this ordinance. SECTION 7. This ordinance shall be in full force and effect from and after its passage and publication as required by law and it is so ordained. APPROVED AS TO FORM AND LEGALITY: 65 w !
