AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE WATER AND SEWER CAPITAL PROJECTS FUND
IN THE AMOUNT OF $529,294 .00, TRANSFERRED FROM AVAILABLE FUNDS
IN THE WATER AND SEWER FUND, FOR THE PURPOSE OF FUNDING THE
TRINITY RIVER VISION PHASE 1 PROJECT (CITY PROJECT NO. C00969);
PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts a llocated to the various City departments for Fiscal Year 2022 -2023 in the
Budget of the C ity Manager, there shall a lso be increased estimated receipts and appropriations in the Water
and Sewer Capital Projects Fund in the amount of$529,294.00, transferred from available funds in the Water
and Sewer Fund , for the purpose of funding the Trinity River Vision Phase 1 project (City Project No.
C00969).
SECTION 2.
That should any portion , section or part of a section ofthjs ordinance be declared invalid , inoperative or void
for any reason by a co urt of competent jurisdiction, such decision, opinion or judgment shal I in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remainin g provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ord in ances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby express ly repea led .
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council :
1. Authorize execution of a contract with William J . Schultz , Inc. dba Circle C Construction Company in the amount of $4 ,994,602.00 for the
Water & Sanitary Sewer Main Relocations for the Fort Worth Central City Project Section 1: Part 1 O proje ct ; and
2 . Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water & Sewer Capital Projects Fund
in the amount of $529,294 .00 , transferred from available funds within the Water and Sewer Fund, for the purpose of funding the Trinity River
Vision Phase 1 project (City Project No. C00969) to effect a portion of Water's contribution to the Fiscal Years 2023-2027 Capital
Improvement Program .
DISCUSSION :
The purpose of this Mayor and Council Communication (M&C) is to authorize execution of a contract with William J . Schultz , Inc . dba Circle C
Construction Company in the amount of $4 ,994 ,602 .00 for the Water & Sanitary Sewer Main Relocations for the Fort Worth Central City Project ,
Section 1: Part 10 -Water & Sanitary Sewer Relocations project-c ity projectTrinity River Vision Phase 1.
The project consists of Section 1 of the water and sewer re locations as indicated on the following streets and easements to accommodate the
proposed United States Army Corps of Engineers Bypass Channel Segment:

The project was advertised for bid on February 2 and 9 , 2023 , in the Fort Worth Star-Telegram. On March 2 , 2023 , the following bids were

In add ition to the contract amount $481,804 .00 (water: $127 ,059 .00; sewer: $354 ,745 .00) is required for project management , material testing
and inspection and $261 ,717.00 (water: $71 ,920 .00 ; sewer $189,797 .00) is provided for project contingencies .
This project will have no impact on the Water Department's operating bu dget when complete.
It is the practice of the Water Department to appropriate its CIP plan throughout the fiscal year, instead of within the annual budget ordinance , as
projects commence, additiona l funding needs are identified, and to comply with bond covenants . The actions in the M&C will amend the City of
Fort Worth 's Fiscal Year 2023-2027 Capital Improvement Program as fo ll ows :

The sanitary sewer $3,795 ,938 .00 amount of this contract and the sanitary sewer $75 ,900 .00 amount of material testing fees (to be performed by
a geotechnical testing firm) are considered Trinity River V ision (TRV)-re lated work , which are eligible for funding from Tax Increment Rein vestment
Zone No.9 (TRVA T IF) purs uant to the TRVA Project Plan . Having met its $26 .6 million commitment to the TRV Project , the City will be reimbursed
the sanitary sewer amount of $3 ,871 ,838.00 by the Tarrant Regional Water District (TRWD) upon project completion , in accordance with the
provisions of the executed lnterlocal Agreement between the City and the TRWD (City Secretary Contract No . 43425 , as amended). Staff wil l
record a rece ivab le every month for reimbursable expenses , and the TRV Program Manager in the Planning & Data Analytics Department wi ll be
responsible for collecting the full reimbursement from TRWD upon project completion .

B usi ness Eq uity: William J. Schultz, Inc . dba Circle C Construction Company is in compliance with the City's Business Equity Ordinance by
committing to 17 % MWBE participation on this project. The City's MWBE goal on this project is 17%.
The project is located in COUNCIL DISTRICT 2 and FUTURE Council District 2 .
FISCAL INFORMATION /CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Water and Sewer Fund , and upon approval of the above recommendations
and adoption of the attached appropriation ordinance, funds will be available in the W&S Capital Projects Fund for the Trinity River Vision , Phase
1 project to support the approval of the above recommendations and execution of the construction contract. Prior to an expenditure being incurred ,
the Water Department has the responsibility of verifying the availability of funds .
