AN ORDINANCE AMENDING CHAPTER 13 OF THE FORT WORTH
CITY CODE (1964) , AS AMENDED, DANCE HALLS AND POOL
HALLS, BY AMENDING SECTIONS 13-25, 13-28o 13-35
AND 13-39; PROVIDING DEFINITIONS; REQUIRING AN OC-
CUPATION TAX; REGULATING HOURS OF OPERATION; PRO-
VIDING EXCEPTIONS, MAKING THIS ORDINANCE CUMULATIVE
OF PRIOR ORDINANCES, REPEALING ALL ORDINANCES AND
PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT
HEREWITH; PROVIDING A SEVERABILITY CLAUSE; PROVID-
ING A PENALTY; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That Section 13-25 of Chapter 13 of the Fort Worth City
Code (1964) , as amended, is hereby further amended by adding
thereto the following:
"Sec. 13-25. Definitions.
"Coin-operated billiard or pool table.
Every coin-operated table surrounded by a ledge
or cushion with or without pockets, upon which
balls are impelled by a stick or cue."
SECTION 2.
That Section 13-28 of Chapter 13 of the Fort Worth City
Code (1964) , as amended, is hereby further amended and, after
being so amended, shall hereafter read as follows:
"Sec. 13-28. Same -- Fees.
"From every person, firm, association of
persons, corporation and every other organization,
save and except religious, charitable or educa-
tional organizations authorized under the laws
of the State of Texas, owning and operating for
profit any billiard or pool table or any coin-
operated billiard or pool table, as defined under
this Article, there shall be collected an annual
occupation tax of Two Dollars and Fifty Cents
($2.50) on each billiard or pool table and Seven
Dollars and Fifty Cents ($7.50) on each coin-
operated billiard or pool table.
"From every person, firm, association of
persons, corporation and every other organiza-
tion, save and except religious, charitable or
educational organizations authorized under the
laws of the State of Texas, owning and operating
for profit any billiard or pool table, as de-
fined under this Article, there shall be col-
lected on each billiard or pool table an annual
license fee of Ten Dollars ($10.00) ."
SECTION 3.
That Section 13-35 of Chapter 13 of the Fort Worth City
Code (1964) , as amended, is hereby further amended and, after
being so amended, shall hereafter read as follows:
"Sec. 13-35. Hours of operation.
"All pool halls shall close and shall not
operate during those hours of each day or night
during which the sale of any alcoholic beverage
is prohibited by the laws of the State of Texas. "
SECTION 4,
That Section 13-39 of Chapter 13 of the Fort Worth City
Code (1964) , as amended, is hereby further amended and, after
being so amended, shall hereafter read as follows:
"Sec. 13-39. Exceptions from applicability
of Article.
"The provisions of this Article shall not
apply to religious, charitable or educational
organizations, authorized under the laws of the
State of Texas, even though a charge is made for
playing, where use of the pool or billiard tables
or coin-operated billiard or pool tables is
restricted to the members of the organization
and from which the general public is excluded."
SECTION 5.
That this ordinance shall be cumulative of all provisions
of the Code of the City of Fort Worth (1964) , as amended, with
respect to pool halls in the City of Fort Worth, except in
those instances where the provisions of this ordinance are
in direct conflict with the provisions of such Code, in which
instances said conflicting provisions of such Code are hereby
repealed.
SECTION 6.
That it is hereby declared to be the intention of the
City Council that the sections, paragraphs, sentences,
clauses and phrases of this ordinance are severable, and
if any phrase, clause, sentence, paragraph or 'section of
this ordinance shall be declared void, ineffective or un-
constitutional by the valid judgment or final decree of any
court of competent jurisdiction, such voidness, ineffective-
ness or unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sec-
tions hereof, since the same would have been enacted by the
City Council without the incorporation herein of any such
void, ineffective or unconstitutional phrase, clause, sen-
tence, paragraph or section.
SECTION 7.
That any person, firm, association of persons, company
or corporation, or their agents, servants or employees who
violate, disobey, omit, neglect or refuse to comply with
any provision of this ordinance shall be punished by a fine
not to exceed Two Hundred Dollars ($200.00) , and each day
that a violation exists shall be and is hereby declared to
be a distinct and separate offense and punishable as such,
all as provided for in Section 1-5 of Chapter 1 of the Code
of the City of Fort Worth (1964) , as amended.
SECTION 8.
That this ordinance shall become effective and be in full
force and effect from and after its passage and publication
as required by law, and it is so ordained.
