A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS CONSENTING TO THE AllDITION OF
497.066 ACI2ES OF LAND BY BROOKFIELD WATER CONTROL
AND IMPROVEMENT DISTRICT OF DENTON COUNTY AND
SUPERCEDING RESOLUTION 5427-06-2021 THAT ADDED
489.816 ACRES OF LAND; PROVIDING FOR SEVERABILITY
AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth (the "City") previously
adopted Resolution No. 5427-06-2021 consenting to the addition of approxiinately 489.816
acres of land in the City's extraterritorial jurisdiction ("ETJ") to the boundaries of
Brookfield Fresh Water Supply District No. 1 on June 22, 2021, consisting of 407.409
acres ("Tract 1") and 82.407 acres ("Tract 2") (coilectively, the "Original Consent
Property"); and
WHEREAS, Brook�ield Fresh Water Supply District No. 1 was subsequently
converted to a water control and improvement district and renamed Broolc�eld Water
Control and Improvement District of Denton County (the "District"); and
WHEREAS, on November 4, 2022, the Distt•ict received a petition for the addition
of 453.818 acres of land (the "Petition Property"), being a portion of and fully contained
within the Original Property; and
WHEREAS, due to the provisions of Section 51.714, Texas Water Code, the District
was unable to add the entirety of the Original Property in a singie calendar year; and
WHEREAS, on November 4, 2022, the District added 230 acres of the Petition
Property, which was also a portion of the Original Consent Property desci•ibed in Resolution
No. 5427-06-2021 to the District, by Order of the Board of Directors; and
WHEREAS, on February 6, 2023, the District added the remaining 223.818 acres
of the Petition Property, which was also a portion of the Original Consent Pr•operty described
in Resolution No. 5427-06-2021 to the District, by Order of the Board of Directors; and
WHEREAS, Double R DevCo, a Texas limited liability company ("Double R"), is
the owner of 494.840 acres of land, consisting of (i) Tract 1, (ii) a portion of Tract 2,
consisting of 78.697 acres of land, and (iii) approximately 8.721 acres of land adjacent to
Tract 1(collectively, the "Double R Property"); and
WHEREAS, DRH-Highway 114, LLC, a Delawai•e limited liability company
("DRH"), owns approximately 2.226 acres of land in the City's ETJ, consisting of right-of-
way for Pembine Lane (the `Pembine ROW"), which will be constructed by or on behalf of
the District to connect the Property to State Hwy 114; and
WHEREAS, the District has provided the City with a copy of Double R's petition
to the City for the consent to the addition of all of the Double R Property that was not
annexed by the District by order dated November 4, 2022 or order dated Februaiy 6, 2023,
and has t•equested that the City provide a consent resolution evidencing the City's consent
to the addition of such property to the District; and
WHEREAS, the District has provided the City with a copy of DRH's petition to the
City for consent to the addition of the Pembine ROW to the District and requested that the
City pr•ovide a consent resolution evidencing the City's consent to the addition of the
Peinbine ROW to the District; and
WHEREAS, the City Council finds that it is in the public interest to grant consent
to the addition to the Distl•ict of the Double R Propei•ty that has not been annexed by the
District and the Pembine ROW, talcing into consideration the public health, safety and
general welfare;
NOW, THE1tEFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF FORT WORTH, TEXAS:
Section 1. The City hereby consents to the addition of the Double R Propei�ty to the
District in accordance with Double R's petition and the addition of the Peinbille ROW to
the District in accordance with DRH's petition, which are attaehed hereto and incotporated
herein by reference as Exhibit "A" and Exhibit "B", respectively.
Section 2. This consent resolution supercedes Resolution No. 5427-06-2021 but in
no way affects (i) the City's consent to addition of Petition Property, consisting of a portion
of the Double R Property, to the District pursuant to such resolution or (ii) the validity of
the Novembei• 4, 2022 and February 6, 2023, Orders Adding Lands and Redefining
Boundaries approved by the Board of Directors of the District.
Section 3. The consent of the City to the addition of the Pembine ROW and the
Double R Property to the District does not in any way release the Peinbine ROW or the
Double R Pt�operty fi�om the extraterritorial jurisdiction of the City.
Section 4. The requirements to renegotiate and execute development agreements or
other agreements with the City, including creation and operation agreements and utility
agreements set out in Section 3 of the Original Consent Resolution have been fully satis�ed
and the City Council's consent to addition of the Double R Property and the Pembine ROW
to the District is not subject to conditions.
Section 5. The terms and provisions of this Resolution shall be deemed to be
severable and if the validity of any section, subsection, sentence, clause, or phrase of this
Resolution should be declared to be invalid, the same shall not affect the validity of any
other section, subsection, sentence, clause or phrase of this Resolution.
Section 6. This Resolution shall take effect immediately upon its passage.

acting pursirant to the provisians of Sectxon 42.045, Texas Local Governrnent Code, as amended,

lmproverr►ent District of Denton Cou�rty (the "District"). In support of this petition, Petiiioner shows
as follows:
The Distriot, to which the land l�ereinaftsr described is sought to be annexed, eaisis under the
terms and pro�visions of At�ticte XVI, Section 59 and Articie III, Section 52 of the Constitution of
Texas, and Chapters 49, 51 and, for limited purposes, 53, Texas 'Water Code, as a.inended. Latldowner
is the sot� owner and holder of fee simple title to the land sought to be ann�xed io the District, as
indicated by the tax rolls of the central appraisal distric# af Denton Co�mty, Texas. Lanc�owner
rep�•esents and waxrants that there are no holders of liens against said land.

The land sought to be added to the District eontains approxima�ely 494,84 acx•es of land, more
or less, as described in Exhibit "A", attached hereto and incorporated herein by xeference, and lies
wholly within Denton County, Texas (the `Land"), which has not previously been added to the
District as set in Section IV. No part af said area is within the limits of any incarporated city or town.
Under the provisions of Section 42.001, Local Government Code, as amended, said area is �svithin the
extraterritoriat jurisdiction. ofthe City o�Fort Worth and is not witl�iti such jiarisdiction oiany other
city. Al] of the territory to be annexed may propei�ty be annexed to t��e District.
III.
The Land ino3udes a portio�a af the 489.816 acres which the City of Part Worth consey�ted to
addition by the District by Resolution No. 542'�-06-2021 approved on June 22, 2021, as well as
additional land owneci by ihe Landowner that was not descri6ed in such resolution,

IV.
The Dish'ict approved adding 230 acres of tiie Laiid by ordei• of flie Board of Directors
of the District dated No�vember 4, 2022, all of which is contaii�ed w'rthin the 489.8I6 acres ofland
described in Reso]ution No. 5427-06-2021.

The general nature of the work proposed to be done in the a�•ea sou�;ht to be aimexed
sl�all be Yhe pux'c4xase, coustcuction, acquisi#ion, repair, exte:nsion aud itnprovement of Iand,
easements, works, improvements, facilities, plants, equipment and appfzances ��eoessaiy to,
(1) provide a water supply for municipal, domestic and cammercial p��rposes;
(2) collect, transpoxt, process, dispose of and cot�t�•ol ali domestic,
indiistrial or coxnmunal wastes whether in fluid, solid or composite state;
(3) gather, conduct, divert and controi local storm water or other lia���nful excesses
of tivater in t(Ze a�•ea; and
(4) the consh�uction, operation and maintenance of roads serving #he Dist�•ici.
VI.
The area of the District is urban in nature, 'rs near the growing environs of the City oi
Fort Warth, and is in close proximity to popuious and developed sections of l�enton Coui�ty.
There is a necessity for the iniprovements described above because the land sought to be added
to the District is rtot supp[ied wiTh adequate water, sanitary sewer, drainage or road facilities, nor
is ie presently economically feasible for such facilities to be added to said land, The health and
welfare af tlie preseiit ar�d future inhabita��ts of the District, the land soughi to be added to #he
District, and of #he territories adjacent thereto require the installation and aequisition of adequate
water, sanitary sewer, drainage and road facilities for the land sought fio be added to t3�e District.
VII.
A pub[ic necessity exists for the addition of said Jands to the District to promote aud
protect the pui•ity and sanitary condition of the State's waters and the public healtll and welfara
of the cornmunity, by and through ihe constructian, extension, improvement, cnaintenance and
aperafiorti ofwater, sanitary sewer, drainage and road facilities.
WHEREFORE, Petitioner respeetfutIy prays that t��is petition be gr�nted in all respects
and that tlie City of Fort Worth give its eonsent to the annexation ofthe aforesaid land into said
Dis�rict.

DRH-HIGHWAY 114, LLC, a a Delaware limited liability company, being the holder of
title to all of, and therefore, a majority in value of the land hereinafter described, as such values are
indicated by the tax rolls of the central appraisal district of Denton County, Texas ("Landowner" or
"Petitioner"), acting pursuant to the provisions of Section 42.045, Texas Local Government Code, as
amended, respectfi�lly petitions for consent to include additional land in Brookfield Water Control
and Improvement District of Denton County (the "District"). In support of this petition, Petitioner
shows as follows: .
I.
The District, to which the land hereinafrer described is sought to be annexed, exists under the
terms and provisions of Article XVI, Section 59 and Article III, Section 52 of the Constitution of
Texas, and Chapters 49, 51 and, for limited purposes, 53, Teaas Water Code, as amended. Landowner
is the sole owner and holder of fee simple title to the land sought to be annexed to the District, as
indicated by the tax rolls of the central appraisal district of Denton County, Texas. Landowner
represents and warrants that there are no holders of liens against said land.
II.
The land sought to be added to the District contains approximately 2226 acres of land, �nore
oi• less, as described in Exhibit "A", attached hereto and incorporated herein by reference, and lies
wholly within Denton County, Texas (the "Land"). No part of said area is within the limits of any
incorporated city or town. Under the provisions of Section 42.001, Local Government Code, as
amended, said area is within the extraterritorial jurisdiction of the City of Fort Woi�th and is not within
such jurisdiction of any other city. All of the territory to be annexed may properly be annexed to the
District.
III.
The general nature of the work proposed to be done in the acea sought to be annexed shali
be the purchase, construction, acquisition, repair, extension and improvement of land, easements, works,
improvements, facilities, plants, equipment aud appliances necessary to:
(1) provide a water supply for municipal, domestic and commercial purposes;
(2) collect, transport, process, dispose of and control all domestic,

industrial or commuual wastes wl�ether in fluid, solid or composite state;
(3) gather, conduct, divei-t and control local storm water or other harmful excesses of
water in the area; and
(4) the construction, operation and maintenance of roads serving the Dish•ict.

The area of the District is urban in nature, is near the growing environs of the City of Fort
Worth, and is in close proximity to populous and developed sections of Denton County. There is a
necessity for the improvetnents desct•ibed above because the land sought to be added to the DistY•ict is
not supplied with adequate water, sanitaiy sewer, drainage or road facilities, nor is it presently
economically feasible for such facilities to be added to said land. The health and welfare of the present
and future inhabitants of the District, the land sought to be added to the District, and of the territories
adjacent thereto require the installation and acquisition of adequate water, sanitary sewer, drainage and
road facilities for the land sought to be added to ihe District.
V.
A public necessity exists for the addition of said lands to the District to promote and protect
the purity and sanitary condition of the State's waters and the public health and welfare of tlle
commtmity, by and through the construction, eatension, improvement, maintenance and operation of
water, sanitary sewer, drainage and road facilities.
WHEREFORE, Petitioner respectfully prays that this petition be granted in all respects and
that the City of Fort Worth give its consent to the annexation of the aforesaid land into said District.
