HomeMy WebLinkAboutOrdinance 26066-04-2023ORDINANCE NO. 26066-04-2023 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE TRANSPORTATION IMPACT FEE CAPITAL FUND, IN THE AMOUNT OF $1,200,000.00, FROM AVAILABLE FUNDS WITHIN THE REVENUE SA AA TRANSPORTATION IMPACT FEES PROJECT (CITY PROJECT NO. UN9929), FOR THE PURPOSE OF FUNDING THE INTERMODAL PARKWAY IMPROVEMENTS PROJECT (CITY PROJECT NO. 103332); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to tho se amounts allocated to the various City departme nt s for Fiscal Year 2022-2023 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Transportation Impact Fee Capital Fund in the amount of $1,200,000.00, from available funds within the Revenue-SA AA Transportation Impact Fees project, for the purpos e of fundin g Intermodal Parkway Improvements project (City Project No. 103332). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction , such decision, opinion or judgment shall in no way impair the remaining portions, sections , or parts of sections of this ordinance, which said remainin g provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with s uch other ordinances and appropriations, in which in stance said conflicting provi s ions of said prior ordinances and appropriations are hereby expressly repealed . SECTION 4. This ordinance shall take effect upon adoption. DISCUSSION: lntermodal Parkway is a commercial corridor connecting the Burlington Northern Santa Fe Railroad (BNSF) lntermodal Facility and related businesses in the Alliance area to Old Blue Mound Road (Old FM 156) and ultimately to Interstate 35 West (l-35W) via Westport Parkway . lntermodal Parkway is a 30-year-old partially built road that stretches approximately 2 .5 miles from the BNSF lntermodal Facility , with the first mile in the City and then connecting to the next 1.5 miles through the City of Haslet to Westport Parkway and on to l-35W. The Parkway serves as the lifeline for the freight , supply chain and e-commerce activities in the City and Tarrant County. This roadway connects the North America 's largest inland port , the Alliance Texas Global Logistics Hub and its supply chain logistic partners to major employers , commun ities and other transportation systems , including air, rail and interstate h ighway. Being delivered by a public-private partnersh ip led by Hillwood , it continues to be a project of sign ificance for regional improvements being led by North Central Texas Council of Governments (NCTCOG), City of Fort Worth , City of Haslet, Tarrant County and Hillwood . On June 22 , 2021 , City Council adopted an appropriation ordinance increasing receipts and appropriations in the Transportation Impact Fee Funds in the amount of $5 ,500 ,000 .00 for the lntermodal Parkway project from available funds within Impact Fee Service Area AA, as well as an additional $250,000.00 in the Developer Contribution Fund from completed Future Improvement Agreement funding (Mayor and Council Communication (M&C) 2 1-0500). On August 3 , 2021 , Tarrant County awarded $6 ,750,000.00 of its 2021 Bond Program for the lntermodal Parkway project. The County Bond Program requires City matching funds dollar per dollar. The project cost has increased to $13 ,715 ,363.00, and in addition , some of the project elements are inelig ible for either funding source , creating a budget shortfall of $2 ,215,362.48 . An additional $484,637 .52 is being appropriated for contingencies , for a total appropriation of $2 ,700 ,000 .00. As a part of the Fiscal Year 2022 year-end process , the lnterrnodal Parkway Improvements project has been identified to use available fund balance from the General Fund to close this funding gap. The action in this M&C will amend the Fiscal Year 2023 Adopted Budget as approved in connection with Ordinance 25773-09-2022 , Section 1. General Fund , as listed on page(s) 3 . Upon approval of this M&C , appro ximately , $7 .9 million will remain for future appropriation by Mayor and Council. This project is located in COUNCIL DISTRICT 7 and FUTURE COUNCIL DISTRICT 10 . A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity . FISCAL INFORMATION /CERTIFICATION: The Directo r of Finance certifies that funds are currently available in the fund balance within the General Fund and in the REVENUE-SA AA - Transp Imp Fee project within the Transportation Impact Fee Cap Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances , funds will be available in the CFA lntermodal Parkway project.
