HomeMy WebLinkAboutOrdinance 17226-10-2006Ordinance No. 17226-10-2005 AN ORDINANCE INCREASING APPROPRIATIONS IN THE ENVIRONMENTAL MANAGEMENT OPERATING FUND IN THE AMOUNT OF $27,000 AND DECREASING THE UNRESERVED, UNDESIGNATED FUND BALANCE BY TIDE SAME AMOUNT, FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE ENVIRONMENTAL MANAGEMENT PROJECT FUND TO APPLY FOR A MUNICEPAL SETTING DESIGNATION IN SUPPORT OF THE TRINITY UPTOWN PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2005- 2005 in the Budget of the City Manager, there shall also be increased appropriations in the Environmental Management Operating Fund in the amount of $27,000 and decreasing the unreserved, undesignated fund balance by the same amount, far the purpose of transferring said funds to the Environmental Management Project Fund to apply far a Municipal Setting Designation in support of the Trinity Uptown Project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a courk of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. G-15436 SUBJECT: Approve Transfer of Funds for Administrative Costs and Application Fees to Receive a Municipal Setting Designation for the Trinity Uptown Project and Adopt Appropriation Ordinances RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached appropriation ordinance increasing appropriations in the Environmental Management Operating Fund {R1a3) by $27,aaa.DO and decreasing the unreserved, undesignated fund balance from available funds; 2. Approve the transfer of $27,OOa.aO in undesignated funds in the Environmental Management Operating Fund to the Environmental Management Project Fund (R101); and 3. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the Environmental Management Project Fund by $27,aao.a0. DISCUSSION: On July 11, 2aa6, {M&C C-215B3) City Council approved an interlocal agreement with the Tarrant Regional Water District for the City's provision of environmental services to the District for public purposes relating to the Trinity Uptown Project. Under the terms of the agreement, the City will act as the applicant and receiver of a Municipal Setting Designation for the entire project to aid the District with remediation. Specifically, the Environmenta! Management Department will file applications far a municipal setting designation {MSD) in support of the Trinity Uptown Project. The first application will be with the City of Fort Worth itself, and later with the Texas Commission on Environmental Quality for certification of the MSD. The funds being appropriated will be used for public meetings and outreach, research for preparation of the application, surveying of properties as necessary, application fees, and consultant fees. FISCAL INFORMATIONICERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the current operating budget, as appropriated, in the Environmental Management Project Fund.
