AN ORDINANCE AMENDING CHAPTER 16 OF THE FORT WORTH CITY CODE (1964) , AS AMENDED, WHICH CHAPTER REGULATES SOLID WASTE COLLECTION, FEES, AND DISPOSAL, BY AMEND- ING SUBSECTION (a) OF SECTION 16-19, DUMPING FEES, BY INCREASING THE FEE PERTAINING TO REFUSE CONTAINER VEHICLES; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY; AND NAMING AN EFFECTIVE DATE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That subsection (a) of Section 16-19 of the Code of the City of Fort Worth (1964) , as amended, be and the same is hereby amended so that hereafter same shall be and read as follows: " (a) Persons disposing of refuse at any City operated disposal site, incinerator, dump or sanitary landfill, including persons holding a valid permit for private collection and disposal of refuse, shall pay a dumping fee for each and every load of refuse dumped or deposited in accordance with the schedule of charges set out below. These charges shall not be applied to loads of refuse collected by the Texas Highway Department from rights-of-way of public streets and highways, nor to disposal of refuse resulting from the activities of any department of the city govern- ment. .,Type of Vehicle Fee "Passenger automobiles and No charge station wagons "All other vehicles and refuse $2.80 per ton containers (nearest 1/4 ton) of refuse "Earth, rocks, and inert material No charge suitable for cover of refuse. (The acceptability of such mate- rial shall be determined by the Sanitation Superintendent or his authorized representative and shall be delivered to sites desig- nated by him.) " SECTION 2. That this ordinance shall be cumulative of all provisions of the Code of the City of Fort Worth (1964) , as amended, and all other ordinances of the City of Fort Worth, except in those instances where the provisions of this ordinance are in direct conflict with the provisions of such Code or other ordinances, in which instances said conflicting provisions of such Code or other ordinances are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitution- ality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. That the violation of any provision of this ordinance or of the Fort Worth City Code relating to the payment of fees therefor shall be deemed an offense and punishable by a fine not exceeding Two Hundred Dollars ($200) , and each violation thereof and each day there is a failure to comply with the terms of this ordinance shall be and is hereby deemed to be a distinct and separate offense and punishable as such. -2- SECTION 5, That this ordinance shall become effective and be in full force and effect from and after the date of its passage and publication as required by law, and it is so ordained, APPROVED AS TO FORM AND LEGALITY: 4�; 6 OOOA"Om� 0 City Attorney Adopted MC, zq, r9 73 -3- City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE susigm., Proposed Increase in Fee for PAGE 5/29/73 NUMSER Dumping at Sanitary Landfills I Of G-2199 On June 28, 3.971 (14&C G-1779) , Ordiriance- No. 650 was adopted setting the fee for dumping at the Cit,y's sanitary landfills at $2.0�O per ton. 'rhe fee is charged for all conmnercial and private vehicles, except private automobiles, depositing at the landfills. At present, there are 159 coimnercial and 631 private waste hauling permits in effect, allowing dumping in the City's landfills. S,ome twenty nearby cono unit ,ea deposit ail ar part of their refuse in Fort Worth facilities. In fiscal 1971-72, 64,856 tons of commercial refuse and refuse from other cities were dumped by private haulers at the landfills; this quantity represents approximately 23 percent of to toInnage handled at the lanAfills during the year. For the preceding year, the tonnage was 88,583, or 24 percent. In order to assure that all hattlers pay a fa,ir price for the disposal of solid waste and that the use of the sites by others does not cause a loss to the citizens of Fort Worth, the staff has recently made a study Df current Landfill operating costs. The actual cost per ton, for fiscal 1971-72, including land replacement costs, was $2.319; for the first five mon'ths o f 1972-73, the cost was $2.383. "The fees are calculated to, the aearest quarter ton, and playntent is made at the time of dumping, either in cash or with tickets sold by the Health Department. It is therefore desirable that the fee be easily divisible by tsar, so that these transactions will not be unreasonably complicated. It is proposed that tbe fee be increased to $2.80 per ton, to cover all landfill operating costs and to provide a rate that should be sufficient for a reasonable period of time. It Is proposed that the new fee be made effective July 1, 1973. Recoamwandation It is recommended: 1) That an ordinance be adopted establishing $2.80 per ton as the fee charged for all commercial and rivate vehicles, except private automobiles, &Lsposing of re. use at the City's sanitary landfills; and, 2) That the new rate become, effective July 1, 1973.
