G AN ORDINANCE MAKING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 17.715 ACRES, MORE OR LESS, OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA SHARE OF TAXES; PROVIDING THAT THE IINHABITANTS THEREOF SHALL HAVE ALL OF THE PRIVILEGES OF ALL THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Chamber in the City Hall of Fort Worth, Texas, on the 21st day of May, 1973, which date is not more than twenty (20) nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published in a newspaper having general circulation in the City of Fort Worth, Texas, and in the herein- after described territory on the 9th day of May, 1973, which date is not more than twenty (20) nor less than ten (10) days prior to the date of such Public hearing; and WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 390,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas, was 233.33 square miles on January 1 , 1973; and WHEREAS, the hereinafter described territory lies within the extra- territorial jurisdiction of the City of Fort Worth, Texas; and - 2 - WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the territory hereinafter described contains approximately 17.715 acres; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I. That the following described land and territory located approxi- mately 10 miles north from the Courthouse of Tarrant County, Texas, lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the boundary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to wit: BEGINNING at a point in the present corporate boundary of the City of Fort Worth, said point being in the west right-of-way line of County Road No. 4048 where it is intersected by a westward prolongation of the south right- of-way line of County Road No. 4104; THENCE S 89 degrees 35' W along a westerly prolongation of the south right-of-way line of County Road No. 4104, a distance of 2968.0 feet to a point for a corner in the east right-of-way line of Interstate Highway No. 35W; THENCE N 00 degrees 03' E along the east right-of-way line of Interstate Highway No. 35W, a distance of 260 feet to a concrete monument a point for a corner; THENCE N 89 degrees 35' E, a distance of 2968.0 feet to an iron pin in the west right-of-way line of County Road No. 4048, a point for corner; ` - 3 - THENCE S 00 degrees 06' W along the west right-of-way line of County Road No. 4048, a distance of 260 feet to the POINT OF BEGINNING and containing 17,715 acres of land. SECTION 2. That the foregoing-described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata share of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. SECTION 3. That this ordinance shall and does hereby amend every prior ordi- nance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumulative. SECTION 4. If any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional , by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases` or words except as the same are inseparable from and indispensable to the remaining portions of the ordinance. SECTION 6. This ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXYIII of the Charter of the City of Fort Worth and it is so ordained. - 4 - APPROVED AS TO FORM AND LEGALITY: City Attorney day of 1973. The owner of the property has presented to the City Secretary a petition for annexation accompanied by the required affidavits attesting that the petition has harurn duly gnanlrlt,shnnnl and posted and that no persous reside inn the a°a"aai, requested for annexation. The request has been reviewed by the City departments and their findings have been reviewed. The City Plan t.«wniuissio n has recommended annexation of the 17.717 acres as requested.
