Date Received: 4/24/2023 Time Received: 1:14 p.m. Record Number: PN22-00177 City Secretary No.: 57982-A1 FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO.579823 EASEMENT ENCROACHMENT LICENSE AGREEMENT This SECOND AMENDMENT TO CITY SECRETARY CONTRACT NO.57982, EASEMENT ENCROACHMENT LICENSE AGREEMENT is made and entered into by and between the CITY OF FORT WORTH, a home rule municipal corporation of Tarrant County, Texas ("City"), acting herein by and through its duly authorized City Manager, Assistant City Manager, or Development Services Department Director, and Broadway Acquisition LP, a(n) Texas limited partnership ("Licensee"), acting herein by and through its duly authorized Manager. RECITALS WHEREAS, City and Licensee made and entered into City Secretary Contract No.57982 on August the 8"', 2022 (the "Agreement"), to authorize the use of the City's right of way for the purposes of installing and maintaining irrigation, plants, benches, stairs and trach receptacles ; and WHEREAS, the parties wish to amend the Agreement to add enhanced landscaping, pavers, retaining wall for landscaping, kinetic wall, and bicycle racks; and WHEREAS, it is the mutual desire of City and Licensee to execute this Amendment to the Agreement to revise "Exhibit A" in the Agreement to depict the revised encroachment area, NOW, THEREFORE, City and Licensee, acting herein by and through their duly authorized representatives, enter into the following that amends the Agreement: 1. "Exhibit A" in the Agreement is hereby replaced with the attached revised description of the encroachment area, labeled as "Revised Exhibit A," OFFICIAL RECORD Revised 12/2022 CITY SECRETARY FT.
