HomeMy WebLinkAboutOrdinance 17227-10-2006Ordinance No. 17227-10-2006 AN ORDINANCE INCREASING APPROPRIATIONS IN THE ENVIRONMENTAL MANAGEMENT PROJECT FUND 1N THE AMOUNT OF $27,000 FROM A TRANSFER FROM THE ENVIRONMENTAL MANAGEMENT OPERATING FUND FOR THE PURPOSE OF APPLYING FOR A MUNICIPAL SETTING DESIGNATION IN SUPPORT OF THE TRINITY UPTOWN PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES 1N CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts al}ocated to the various City departments for Fiscal Year 2005- 2006 in the ~3udget of the City Manager, there shat( also be increased appropriations in the Environmental Management Project Fund in the amount of $27,000 from a transfer from the Environmental Management Operating Fund, for the purpose of to applying #or a Municipal Setting Designation in support of the Trinity Uptown Project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in na way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect, SECTION 3. That this ordinance shall be cumulative of Drdinance No. 16582 and al! other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct can#lict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ord'€nance shall take effect upon adoption. Approve Transfer of Funds for Administrative Costs and Application Fees to Receive a Municipal Setting Designation for the Trinity Uptown Project and Adapt Appropriation Ordinances RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached appropriation ordinance increasing appropriations in the Environmental Management Operating Fund {R103) by $27,000.00 and decreasing the unreserved, undesignated fund balance from available funds; 2. Approve the transfer of $27,000.00 in undesignated funds in the Environmental Management Operating Fund to the Environmental Management Project Fund {R101); and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Environmental Management Project Fund by $27,000.00. DISCUSSION: On July 11, 2006, {M8~C C-21563) City Council approved an interlocal agreement with the Tarrant Regional Water District far the City's provision of environmental services to the District for public purposes relating to the Trinity Uptown Project. Under the terms of the agreement, the City will act as the applicant and receiver of a Municipal Setting Designation for the entire project to aid the District with remediati0n. Specifically, the Environmental Management Department will file applica#ions for a municipal setting designation (MSD) in support of the Trinity Uptown Project. The first application will be with the City of Fort Worth itself, and later with the Texas Commission on Environmental Quality for certification of the MSD. The funds being appropriated will be used for public meetings and outreach, research for preparation of the application, surveying of properties as necessary, application fees, and consultant fees. FISCAL. INFORMATIONlCERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the current operating budget, as appropriated, in the Environmental Management Project Fund.
