ORDINANCE NO. /-�o AN ORDINANCE CLOSING AND VACATING CERTAIN DEDICATED UTILITY EASEMENTS IN LOT 1, BLOCK 1, WOODHAVEN COUNTRY CLUB ESTATES, AN ADDITION TO THE CITY OF FORT WOR'T'H, TARRANT COUNTY, TEXAS; AND PROVIDING FOR THE REVER- SION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS- SECTION 1. That the hereinafter described utility easements in Lot 1, Block 1, Woodhaven Country Club Estates, an addition to the City of Fort Worth, Tarrant County, Texas, be and the same are hereby extinguished, vacated, closed and permanently abandoned as easements for public utilities: Beginning at a point in the southwest corner of Lot 4, Block 6, Woodhaven Country Club Estates, S 65 059'23" W 5 feet; Thence N 35 057'29" W 5 feet to a point for be- ginning; Thence S 65 059123" W 200 feet to a point and parallel with the north line of Lot 1, Block 1, Woodhaven Country Club Estates; Thence S 04 008129" S 10 feet to a point; Thence N 65059123" E 210 feet to a point; Thence N 35 1157129" E 10 feet to the point of beginning. Beginning at a point in the southwest corner of Lot 4, Block 6, Woodhaven Country Club Estates, S 65°59'23" W 5 feet; Thence N 351157129" W 5 feet to a point; Thence S 65 059123" W 215 feet to a point and parallel with the north line of Lot 1, Black. 1, Woodhaven Country Club Estates, to a point for be- ginning; Thence S 65 059123" W 225 feet to a point, said point being in the east line of (proposed) Woodhaven Boulevard; Thence With a Rtlt1859 feet, a length of 10 feet for a point along the east line of proposed Wood- haven Boulevard; Thence N 65°59`23" E 220 feet to a point; Thence N 04 008'29" W 10 feet to the point of beginning. Being 1796.0 square feet or 0.04 acres of land in two tracts situated in Lot 1, Block 1, Woodhaven Country Club Estates, as recorded in Vol. 388-56, pp. 33-36, of the Tarrant County Deed Records, and being more particularly de- scribed by metes and bounds as follows: Beginning at a point in the north line of said Lot 1, Block 1, said point being S 65159'23" W, 183.38 feet from the most southerly corner of Lot 4, Block 6, Woodhaven Country Club Estates; Thence S 12041'4811 W, 86.49 feet to a point; Thence N 04008'2911 W, 73.72 feet to a point, said point being in the north line of said Block 1; Thence N 65159'23" E, 26.64 feet to the point of beginning, and containing 923.47 square feet or 0.02 acres of land more or less; and Commencing at the most southerly corner of said Lot 4, Block 6; Thence S 6505912311 W with said Block 1 north line, 183.38 feet; Thence S 12041'481, W, 138.27 feet to the point of beginning of the tract herein described; Thence S 120411481, w, 147.23 feet to a point; Thence N 09003'30" E, 186.77 feet to a point; Thence S 040081291, E, 40.92 feet to the point of beginning, and containing 872.53 square feet or 0.02 acres of land more or less. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said easements above described is hereby released and shall revert to the adjacent owners of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. Grimes and Michael A. Myers, Trustees, owners of all abutting property, have requested that the City vacate extra easements in Lot 1, Block 1, Woodhaven Country Club Estates. The subject easements, acquired by dedication, do not contain utility facilities. The reviewing N City, departments and private utility companies have no objections to this request provided the property is replatted with the adjoining propertyy A replat has been received by the City staff which indicates retention of the existing sanitary sewer easement and sewer line, and also outlines a relocated drairtage easement and ot1ier necessary easements in the area being replatted. The City Plan Coitmission has rev .coved this request an,d recommends adoption of an ordinance vacating the easements as requested. Recommendation It is recontiended that ari, ordinance be adopted vacating the subject easements as recoinmended by the City Plan Commission.
