HomeMy WebLinkAboutOrdinance 6941 ORDINANCE NO. ` ' l AN ORDINANCE PROVIDING THAT THE FOLLOWING RIGHTS- OF-WAY BE VACATED, ABANDONED AND CLOSED: THE EAST-WEST ALLEYS IN BLOCKS 60 AND 61, RIVERSIDE ADDITION, FIRST FILING, EXTENDING, RESPECTIVELY, FROM THE RIGHT-OF-WAY OF THE CHICAGO, ROCK ISLAND & PACIFIC RAILROAD EASTWARD TO RETTA AVENUE AND FROM RETTA AVENUE EASTWARD TO CHANDLER AVENUE; THE NORTH-SOUTH ALLEY IN BLOCK 79 OF SAID ADDI- TION FROM FISHER AVENUE SOUTHWARD TO ENNIS AVENUE; RETTA AVENUE FROM SAID RAILROAD RIGHT-OF-WAY SOUTH TO FISHER AVENUE; AND CHANDLER AVENUE FROM FISHER AVENUE SOUTH TO ENNIS AVENUE; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN .EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following described rights-of-way in Riverside Addition, First Filing, an addition to the City of Fort Worth, Tarrant County, Texas, be and the same are hereby closed, abandoned and permanently vacated as alleys, streets or public thoroughfares of any kind or character whatever, save and ex- cept that easements are reserved for any and all existing utilities: The east-west alleys in Blocks 60 and 61 of said Addition extending, respectively, from the right-of-way of the Chicago, Rock Island & Pacific Railroad eastward to Retta Avenue and from Retta Avenue eastward to Chandler Avenue; The north-south alley in Block 79 of said Addition from Fisher Avenue southward to Ennis Avenue; Retta Avenue from the right-of-way of the Chicago, Rock Island & Pacific Railroad south to Fisher Avenue; and Chandler Avenue from Fisher Avenue south to Ennis Avenue. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said alleys and streets is hereby released and shall revert to the adjacent owner of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. East-west alley in block 60, Riverside Addition, from railroad right-of-way eastward to Retta Avenue; 2. East-west alley in Block 61, Riverside Addition, from Retta Avenue eastward to Chandler Avenue; 3. North-south alley in Block 79, Riverside Addition, from Fisher Avenue southward to Ennis Avenue; 4. Retta Avenue in the 500 block from the railroad right-of-way south to Fisher Avenue, 5. Chandler Avenue in the 600 black from Fisher Avenue south, to Ennis Avenue; all as shorn on the attached map. The subject rights-of-way were acquired by dedication. There are existing electric, telephone, water and sanitary sewer facilities located therein. The 600 block of Chandler Avenue is opera but not improved in accordance with City standards. Retta Avenue and the alleys are unimproved.. The Public Works Department reports that a drainage easement is needed on Chandler and "Ennis Avenues. Easements will also be needed for all existing utility facilities. Ennis Street must be paved to City specifications and a community facilities contract has been signed to insure the required construc- tion. 'rhe reviewing City departments and private utility companies have no objections to this request provided the vacated right-of-way is replatte with the adjoining property and easements are retained for existing utilities. A satisfactory replat has been received by the City staff. The City Plan Commission has reviewed this request and recommends adoption of an ordinance vacating the public right-of-way as requested. Reco endation It is recommended that an ordinance be adopted vacating the subject rights- of-way as recommended by the City Plan Cor i.ssion..
