HomeMy WebLinkAboutOrdinance 26132-04-2023ORDINANCE NO. 26132-04-2023 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PUBLIC EVENTS CAPITAL FUND, BY INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE JUSTIN GARAGE VENTILATION SYSTEM PROJECT (CITY PROJECT NO. 102447) IN THE AMOUNT OF $146,256.00 AND BY DECREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE UNSPECIFIED PROJECT (CITY PROJECT NO. UNSPEC) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2022-2023 in the Budget of the City Manager, there shall also be adjusted estimated receipts and appropriations in the Public Events Capital Fund, by increasing estimated receipts and appropriations in the Justin Garage Ventilation System Project (City Project No. 102447) in the amount of $146,256.00 and by decreasing estimated receipts and appropriations in the Unspecified Project (City Project No. UNSPEC) by the same amount. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25773-09-2022 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the execution of a construction contract with Denali CS., in the amount of $479,097.00, including 7.5 percent for the owner's construction contingency allowance, for the integration and installation of additional fans into the existing Justin Garage Ventilation System, located at 3401 West Lancaster Avenue; and 2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Public Events Capital Fund by increasing appropriations in the amount of $146,256.00 in Justin Garage Ventilation System project (City Project No. 102447) and by decreasing appropriations in the Unspecified -All Funds project (City project No. UNSPEC) by the same amount. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to provide additional funding to the Justin Garage Ventilation System project and authorize the execution of a construction contract with Denali CS, in the amount of $479,097.00 for integration and installation of additional fans into the existing Justin Garage ventilation system located on the grounds of the Will Rogers Memorial Center. On November 30, 2021, M&C 21-0913 approved the use of $368,500.00 from American Rescue Plan Act funds, Subtitle M (Coronavirus State and Local Fiscal Recovery Funds) for the reinstatement of this project which was deferred as a result of lost Hotel Occupancy Tax Due to the COVID-19 Pandemic. On November 29, 2022, M&C 22-0984 approved the appropriation of $1,000,000.00 from the DFW Revenue Share Fund to the Public Events Capital Fund to supplement anticipated shortfalls in active grant -funded capital projects, of which $146,256.00 of that amount is allocated to supplement this project with approval of this M&C. The City issued a Request for Proposals on December 8, 2022. Pre -proposal meetings and site visits were conducted with interested contractors. On December 22, 2022, the City received 2 responses from contractors, Denali Construction Services., and DMI Corp. Only Denali Construction Services provided the required Post Proposal — Pre -Award Submittals to be further evaluated by the City. Estimated Costs: The estimated costs for design and construction is summarized as follows: WRMC Justin Garage Ventilation -I.-Totals Design $ 12,500.00, Construction Contract, includes Owner's controlled $479,097.00': contingency Project Administration Cost: Project Management, Bid, Survey, Advertisement, Site Utilities, IT, Security, 1$ 35,142.001 Project Management, Contingency, Etc. ANTICIPATED ROJECT TOTAL $526,739.00' With approval of this M&C, funding will be available in the Public Events Capital and Grants Capital Projects Federal Fund for the John Justin Garage Ventilation project, as appropriated. Schedule - Construction is planned to begin during the first quarter of the calendar year of 2023 with an anticipated completion date during the second quarter of the calendar year of 2024. Waiver of Building Permits - In accordance with the City Code of Ordinances, Part II, Chapter 7-1 Fort Worth Building Administrative Code, Section 109.2.1, Exception 2; "Work by non -City personnel on property under the control of the City of Fort Worth shall be exempt from the permit fees only if the work is for action under a contract that will be or has been approved by City Council with notes in the contract packages stating the fee is waived." Diversity and Inclusion Business Equity Office -Denali Construction Services, LP is in compliance with the City's Business Equity Ordinance by committing to 40% Business Equity participation on this project. The City's Business Equity goal on this project is 6%. Additionally, Denali Construction Services, LP is a certified M/WBE firm. Funding is budgeted in the Unspecified -All Funds project of the Public Events Capital Fund and the Grants Cap Project Federal Fund for the purpose of funding the Justin Garage Ventilation System project. Will Rogers Memorial Center is located in COUNCIL DISTRICT 7/ FUTURE COUNCIL DISTRICT 7 FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are currently available in the Unspecified -All Funds project within the Public Events Capital Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the Public Events Capital Fund and the Grants Cap Project Federal Fund for the Justin Garage Ventilation Syst project to support the approval of the above recommendations and execution of the contract.
