AN ORDINANCE AMENDING CERTAIN PARKING REGULATIONS IN DIVISION 2 OF ARTICLE VI OF CHAPTER 26, "MOTOR VEHICLES AND TRAFFIC", OF THE CODE OF THE CITY OF FORT WORTH (1964) , AS AMENDED, BY AMENDING THE PARKING METER RATES OF ZONE NO, 3 AND ADDING ZONE NO, lA TO SECTION 26-103, BY AMENDING THE HOURS FOR FREE USE OF METER SPACES FOR LOADING IN SECTION 26-118, AND BY AMENDING THE COLLECTION PROCEDURE IN SECTION 26-120; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN- CONSISTENT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY; AND PROVIDING AN EFFECTIVE DATE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 26-103 of Division 2, of Article VI of Chapter 26 (Motor Vehicles and Traffic) of the Code of the City of Fort Worth (1964) , as amended, be and the same is hereby amended to read as follows: There are hereby established Parking Meter Zone No, 1, Parking Meter Zone No. 1A, Parking Meter Zone No, 2, Parking Meter Zone No, 3, and Parking Meter Zone No. 4. The traffic engineer is hereby authorized to designate such parking meter zones upon any street or portion of any street where it is determined, upon the basis of an engineering and traffic investigation, that the installation of parking meters shall be necessary to aid in the regulation, control or inspection of the parking of vehicles in the exercise of the police power of regulating, operating or controlling the operation of vehicles using the public streets, The parking of vehicles in such parking meter zones shall be controlled and regulated by parking meters, installed and maintained by the traffic engineer, and located upon the curb immediately adjacent to the individual parking spaces. In the zones so established, the traffic engineer shall designate the maximum parking time for each parking meter, basing his desig- nation upon the investigation above set forth, The fees for parking meter zones so esta- blished shall be as follows: Parking Meter Zone No 1 and 1A: Fifteen (15) minutes for the depositing in the meter of a five cent ($0.05) coin of the United States of America; thirty (30) minutes for the de- positing in the meter of a ten cent ($0.10) coin of the United States of America; and one (1) hour for the depositing in the meter of a twenty-five cent ($0.25) coin of the United States of America. Parking Meter Zone No. 2: Thirty (30) minutes for the depositing in the meter of a five cent ($0.05) coin of the United States of America; one (1) hour for the depositing in the meter of a ten cent ($0.10) coin of the United States of America; and two (2) hours for the depositing in the meter of a twenty-five cent ($0.25) coin of the United States of America. Parking Meter Zone No. 3: one (1) hour for the depositing in the meter of a five cent ($0.05) coin of the United States of America-, two (2) hours for the depositing in the meter of a ten cent ($0.10) coin of the United States of America; and five (5) hours for the depositing in the meter of a twenty-five cent ($0.25) coin of the United States of America. Parking Meter Zone No. 4: one (1) hour for the depositing in the meter of a five cent ($0.05) coin of the United States of America. (Ord. No. 6668, § 1, 5-8-72) SECTION 2. That Section 26-118 of Division 2 of Article VI of Chapter 26 (Motor Vehicle and Traffic) of the Code of the City of Fort Worth (1964) , as amended, be and the same is hereby amended to read. as follows: The use of metered spaces for loading or unloading merchandise shall be permitted during all hours not specifically designated for meter operations by Section 26-104 without the depositing of a coin in the parking meter of such space, except -2- that the vehicle shall load or unload centered. as nearly as possible in a single space. SECTION 3. That Section 26-120 of Division 2, of Article VI of Chapter 26 (Motor vehicle and Traffic) of the Code of the City of Fort Worth (1964) , as amended., be and the same is hereby amended to read as follows: It shall be the duty of the City Traffic Engineer to designate some members of his staff to make regular collec- tions of the money deposited in parking meters. It shall be the duty of such persons so designated to remove the coins deposited. in the meters, to count same, to place same in sealed containers, and to deliver such containers and funds to a place designated by the City Treasurer, It shall be the duty of the city Treasurer to deposit such funds to the credit of the general fund of the City. SECTION 4. That this ordinance shall be cumulative of all provi- sions of ordinances and of the Code of the City of Fort Worth (1964) , as amended., affecting motor vehicles and traffic, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event such conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 5. That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Chapter 26 of the Code of the City of Fort -3- Worth (1964) , as amended, and of any other ordinances affecting motor vehicles and traffic which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such chapter and/or other ordinances, same shall not be affected by this ordi- nance but may be prosecuted until final disposition by the courts. SECTION 6. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or final decree of a court of competent juris- diction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, senten- ces, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incor- poration herein of any such void, ineffective or unconstitu- tional phrase, clause, sentence, paragraph or section. SECTION 7. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor punishable by a fine of not less than one dollar ($1.00) nor more than two hundred dollars ($200.00) . -4- SECTION 8. That this ordinance shall be in full force and effect from and after the date of its passage and publication, as required by law, and. it is so ordained. The attached report entitled PARKING METER D CURB US ` AG E STUDY is submitted as a result of that study. AN In September, 1974, prior to the completion of this report, the City Council adopted the recarmended, change in loading zone rates as described on pages 25, 26, and 27 of this report. The report includes several reconunendations, however, it is believed that decisions to implement these changes should be made on an it by item basis over some reasonable period of time. For this reason, this communication deals onl,y with parking meter expansion and certain necessary changes to the Code of t1ae City of Fort Worth. Other recommendations included in this report will be submitted to the City Council in the near future. The report includes a study of fifty-two curb spaces from a typical section of the unmetered fringe area and fifty-one curb spaces from a typical metered area. (See Appendix A) . It was found that for the unmetered study area, the average turnover rate was 0.14 vehicles per parking space per hour with an average of 6.56 hours. The average occupany during the ten hour study period (7:30 a.m. to 5:30 p.m.) was 90 percent. In the metered area, the average turnover rate was 0.73 vehicles per space per hour or about five times the usage recorded for the unmetered area. The average duration was computed to be 1.14 hours or approximately 17 percent of the, duration in the unmetered area. The average occupancy of the metered spaces, was 81 percent during the study period. It was, determined from this study that the installation of parking meters in the central business district fringe areas shcwn in Figure 6, page 22, of this Report, would provide additional turnover in this area and would provide a better utilization of the parking space available in the fringe areas of the central business district. The 1974-75 Approved Annual, Budget, in anticipation of this report, included funds for the installation of 635 additional parking meters. It was estimated that the cost of installing these meters would be approximately $51,000 and would increase meter revenue by $99,000 per year. Prior to the purchase, of these meters; however, it is necessary that Section 26-103 of the Code be amended. Section 26-103 sets forth the parking meter zones and the rates to be charged, and has been expanded to include the new fringe area meter rates of $0.05 for 60 minutes, $.10 for 120 minutes, and $.25 for 5 hours. If this amendment to the Code is approved, all meters purchased during the current year expansion program will utilite this new rate structure and will allow ,parking tip to five hours. T'he staff also proposes that two other sections of the City Code should be amended at this time. It is the recommendation of the staff that loading and unloading of merchan- dise be free only during the hours not specifically designated for meter operation by Section 26-104 of the Code. Section 26-120 of the City Code presently provides that coins collected from parking meters should be delivered to the City Treasurer for deposit. It is proposed that Section 26-120 be amended to conform with current operating procedure, in that coins are collected, sorted, counted, and placed in sealed containers by the Parking Meter Division staff, and delivered to the City Treasurer ,Oho deposits the revenue to the account of the City of Fort Worth. Recomme Ad , ion It is recommended that 1. the City Council accept the attached PARKING METER AND CURB USAGE STUDY for reference and information at this time, and 2. approve the amendment of Section 26-103, Section 26-118, and Section 26-120 of the Code of the City of Fort Worth as described above.
