HomeMy WebLinkAboutOrdinance 17231-10-2006Ordinance No. 1 7231-1 0-2(}06 AN ORDINANCE INCREASfNG ESTIMATED RECEIPTS AND APPROPRlATfONS IN THE GRANTS FUND IN THE AMOUNT OF $115,2x0 SUBJECT TO EXECUTION OF A CONTRACT WITH THE U.S. EQUAL EMPLOYMENT OPPORTUNITY COMMISSION FOR THE PURPOSE OF FUNDING FAIR EMPLOYMENT OPPORTUNITY ACTIVITIES; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES 1N CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts alloca#ed to the various City departments far Fiscal Year 2006-2007 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $115,200 subject to execution of a contract with the U.5. Equal Employment Opportunity Commission for the purpose of funding Fair Employment Opportunity activities. SECTION 2. That should any portion, section or part ofi a section ofi this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion ar judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full farce and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance Na. 17142 and all other ordinances and apprnpriatinns amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. S. Equal Employment Opportunity Commission to Process Employment Discrimination Cases for Fiscal Year 2005-2007, Authorize Interfund Loan and Adopt Appropriation Ordinance __- - REC®MMENDATION: It is recommended that the City Council: 1. Authorize the City Manager to execute a contract with the U.S. Equal Employment Opportunity Commission (EEOC) in an amount up to $115,200; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in an amount up to $115,200; and 3. Authorize anon-interest bearing interfund loan from the General Fund to the Grants Fund in fhe amount of $55,000 for interim financing fnr this grant, pending contract execution with the EEOC to ensure a smooth transition from one grant funding period to another. ®lscussloN: In January 1977, the EEOC recognized the Community Relations Department {CRD) as a local deferral agency and a Fair Employment Practice Agency {FEPA) in accordance with Section 706 {c) of the U. S. Equal Employment Opportunity Act of 1972, Title Vll of the Civil Rights Act of 1964, as amended. Pursuant to this section, the EEOC prier to asserting jurisdiction over employment discrimination charges, defers such charges for resolution to a local or state agency having authority to enforce a local ar state fair employment law similar to Title Vll, the Age Discrimination in Employment Act and the Americans with Disabilities Act. On September 7, 2006, the CRD, in accordance with EEOC guidelines, submitted a request to the EEOC For reimbursement as follows: a. $108,000 for resolution of 200 charges of alleged discrimination at a cost of $540 per case; b. $6,000 for deferral of 120 non-jurisdictions[ charges of discrimination at a cast of $50 per case; and c. $1,200 for parkial reimbursement of expenses relating to mandatory training at an EEOC sponsored annual conference. Upon review of the CRD submittal and receipt by EEOC of the congressional appropriation for funding of FEPA agencies, the finalized contracts will be forwarded to the City Manager fnr signature. Historically, this occurs late in the second quarter of the fiscal year. Lognanae: 07EEOC2006 Page t o~ 2 Upon execution of the contract, 50 percent of funds are usually paid late in the second quarter and the remaining 50 percent are paid at the end of the fiscal year upon certification of contract completion by EEOC. The interfund loan will provide program funding until payments are received. FISCAl.1NFORMATIONIC~RTIFICATION: The Finance Director certifies that upon approval of the above recommendations, and adoption of the attached appropriation ordinance, funds will be available in the FY2006-07 operating budget, as appropriated, of the Grants Fund.
