AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE, ORDINANCE NU. 3011, AS AMENDED, SAME BEING AN ORDINANCE REGULATING AND RESTRICTING THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCE OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING AND LOADING, AND THE DENSITY OF POPULATION, AND FOR SAID PURPOSES DIVIDING THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST SUITED T0 CARRY OUT THESE REGULATIONS AND SHOWING SUCH DISTRICT AND THE BOUNDARIES THEREOF UPON "DISTRICT MAPS," PROVIDING FOR INTERPRETATION, PURPOSE AND CONFLICT: PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES AFFECTING ZONING: PROVIDING 8 SAYINGS CLAUSE: PROVIDING A SEVEKA8ILITY CLAUSE: PROVIDING A PENAL CLAUSE: AND NAMING AN EFFECTIVE DATE' BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION l' That Ordinance No' 3011 be and is hereby amended so that permitted uses in the hereinafter described areas be altered, changed, and amended as follows: Z-75-68 Tract 6, J. L. Purvis Survey; and Lots N and O, Block l , Waddell Sub- division (600-04-16 Oakland Boulevard) From "B" Two-Family to "E-K" Restricted Commercial Z-75-80 Lot 28, Block 5, Fields Welch Addition (917 Alston) From "D" Apartment to "C-F" Community Facilities Z-75-115 Being 13.34 Acres of land out of the Sanders Elliott Survey, Abstract No. 476, Fort North, Tarrant County, Texas and described by metes and bounds as follows: Beginning at a point in the North line of said Elliott Survey 3307.23 feet East of the Northwest corner, said point being in the centerline of Elliott-Reeder Road' Thence North 89 degreer-30 minutes East, along the centerline of Elliott- Reeder Road and along the North line of Elliott Survey, 629,16 feet to a point for corner: Thence South, at 25.0 feet passing the South line of Elliott Reeder Road, in all, 1025.8 feet to a point for corner in the centerline of Trinity River: Thence North 72 degrees-35 minutes West, along the centerline of said River a distance of 059.34 feet to a point for corner: Thence North, at 797.22 feet passing the South line of Elliott-Reeder Road, in all, 822.22 feet to the point of beginning and containing 13'34 acres of land. They have been designed to lessen congestion i;n the streets; to secure safety from fire, panic, f14od and other dangers; to provide adequate light and air; to prevent over- crowding of land, to avoid undue concentration of population; to facilitate the adequate provisions of transportation, water, sewerage, Parks and other public requirements. They have been made after a full and complete public hearing, with reasonable consideration, among other things, of the.character of the district and i.ts peculiar suitability for the particular uses and with a view of conserving the value of building and encouraging the most appropriate use of land throughout the community. ~ � -4- ' SECTION 3.� That this ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of such ordinances° except in those instances whore provisions of such ordinances are in direct conflict with the provisions of this ordinance. SECTION 4. That all rights or remedies of the City of Fort North, Texas, are expressly saved as to any and all violations of Ordinance No. 3011 or of any amendments thereto of said C�ty of Fort Worth, Texas, that have accrued at the time of the effective date of this ordinance; and, as to such, accrued violations, the court shall have all of the powers which existed prior to the effective date of this urdinnnce. SECTION 5. It is hereby declared to he the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or decree ` of any court or competent jurisdiction, such voidness, Ineffectiveness or un- constitutionality Nall not affect any of the remaining phrases, clauses, sentences, paragraphs or section of thts ordinance, since the same would huve been enacted by the City Counofl without the incorporation he-rein of any such void, ineffective or unconstftutfonal phrase, clause, sentence, paragraph or section. SECTION 6. That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five Dollars ($5.U0), nor more than Two Hundred Dollars ($200.00) for each offense. Each day that a violation 10 permitted to exist shall constitute a separate offense, SECTJIN_7. That this ordinance shall become effective and be in full force and effect frmn and after the date of !ts passage and publication, as required by law" and it is so ordained.
