AN ORDINANCE PERMITTING THE RIDING OF
ANIMALS IN CERTAIN DESIGNATED PARK AND
RECREATION AREAS OF THE CITY OF FORT
WORTH LOCATED WITHIN OR WITHOUT THE
CORPORATE LIMITS OF THE CITY BY AMEND-
ING PARAGRAPH 11 OF SECTION 27-19 OF
CHAPTER 27 OF THE CODE OF THE CITY OF
FORT WORTH (1964) , AS AMENDED; MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH; PROVIDING A
SEVERABILITY CLAUSE,- PROVIDING A
PENALTY; AND PROVIDING AN EFFECTIVE
DATE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS,
SECTION 1.
That paragraph 11 of Section 27-19 of Chapter 27
of the Code of the City of Fort Worth (1964) , as amended,
be and the same is hereby amended, and after being so amended,
shall read as follows:
"Sec. 27-19. Park rules -- Park and recreation areas within
or without the city limits.
"The following rules and regulations shall be
in force in all park or recreation areas including play-
grounds, golf courses and swimming pools of the City of Fort
Worth located within or without the corporate limits of said
City.
.111. It shall be unlawful for any per-
son, without written permission
of the Park and Recreation Director
or without valid current contract
with the City of Fort Worth, to ride
any cow, horse, mule, fowl or domesti-
cated animal in or upon any park or
recreation area not designated.

tethered or pastured, any cow, horse,
mule, fowl or domesticated animal in
or upon any park or recreation area. "
SECTION 2.
That this Ordinance shall be cumulative of all
provisions of the Code of the City of Fort Worth, 1964, as
amended, relative to the riding of animals in certain desig-
nated park and recreation areas of the City of Fort Worth
in those instances where the provisions of this Ordinance
are in direct conflict with the provisions of such Code, in
which instances said conflicting provisions of such Code are
hereby repealed.
SECTION 3.
That if any section, part of a section or pro-
vision of any section of this ordinance shall be held to be
void, ineffective or unconstitutional by a court of competent
jurisdiction, the holding of such section, part of a section
or provision of any section to be void., ineffective or uncon-
stitutional for any cause whatsoever shall in no way effect
the validity of the remaining sections and provisions of this
Ordinance, which shall remain in full force and effect. The
City Council would not have passed any sections, parts of
sections or provisions of any section of this ordinance that
were unconstitutional, void or ineffective if it had known
that they were unconstitutional, void or ineffective at the
time of adopting this Ordinance.

SECTION 4.
That any person, firm or corporation violating
any of the provisions of this Ordinance shall be fined in
any sum not to exceed Two Hundred Dollars ($200.00) , and
each violation thereof shall constitute a separate offense.
SECTION 5.
That this Ordinance shall become effective and
be in full force and effect thirty (30) days from and after
the date of its passage and publication as required by law,
and it is so ordained.

For some time tie Park and Recreatioct Department has experienced problems
controlling the riding of horses n park Areas due to lack of a clear out
del, neation of v�here it is, or is not, permissible to ride horses. This
lack oDtro1 has resulted in horseback riding across playground areas
where children are playing creating a definite safety hazard. Additionally,
there have, been !incidents of gorse. crack riding across ba,ll diamonds, resulting
in damage to playing surfaces with subsequent additional costs for repairs.
The present ordinance goverving horses, clows, fowl, etc. only precludes the
tethering or pastutIng of these animals anid/ar birds in park areas without
'written perwLssion, As !it currently exists the ordinance cannot be used to
control the indiscriminate horseback riding, being experienced in some park
areas. Presently there are three areas where horseback riding is permitted
and, includes South Z. Boaz Park, Cobb Park and Buck Sansom Park.
At a regulax meeting of 'the Park and Recreation Advisory Board on April 13, 1976
the Board considered and voted to recommend 'to the City Council that para-
graph 1.1 of Section 27-1.9, Chapter, 27 of the Code of the City of Fort Worth
be amended by ordinance as indicated in the attached and that this ordinance
be forwarded to the City, Council. for consideration.
Recommendation
It Is reco=ended that the City Council approve the attached ordinance amending
paragraph 11 of Section 27-1.9, Chapter 27 of the Code of the City of Fort Worth.
