ORDINANCE NO.26154-05-2023 AN ORDINANCE VACATING, ABANDONING AND EXTINGUISHING PORTIONS OF PUBLIC ACCESS EASEMENTS LOCATED IN THE WM. MCCOWEN SURVEY, ABSTRACT NO. 999, BLOCK A, ALLIANCE TOWN CENTER ADDITION, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, SUCH PORTIONS OF PUBLIC ACCESS EASEMENTS AS RECORDED IN COUNTY CLERKS FILE NOS. D213300996, D209018951 AND D213195182, REAL PROPERTY RECORDS, TARRANT COUNTY, TEXAS, AND CONTAINING APPROXIMATELY 2.233 ACRES OF LAND COMBINED; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. McCowen Survey, Abstract No. 999, located in Block A and Prairie Vista Drive, Alliance Town Center Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in County Clerk's File Nos. D213300996, Real Property Records, Tarrant County, Texas, and containing approximately 0.735 acres of land, and as more specifically described in Exhibits "A" and "B", attached hereto and incorporated herein by reference, be and the same is vacated, abandoned and extinguished. 2. That a portion of public access easements located in the WM. McCowen Survey, Abstract No. 999, located in Block A, Alliance Town Center Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in County Clerk's File Nos. D209018951 and D213195182, Real Property Records, Tarrant County, Texas, and containing approximately 1.498 acres of land, and as more specifically described Public Access Easement (VA-23-003) Ordinance No. 26154-05-2023 Page 1 of 2 in Exhibits "A" and "B", attached hereto and incorporated herein by reference, be and the same is vacated, abandoned and extinguished. SECTION 2. That the fee to the land in the above described vacated public access easement is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect upon adoption. McCowen Survey, Abstract No. 999, Block A, Alliance Town Center Addition to the City of Fort Worth RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached ordinance vacating two public access easements located in the WM. McCowen Survey, Abstract No. 999, Block A, Alliance Town Center Addition to the City of Fort Worth DISCUSSION: Peloton Land Solutions, Inc. on behalf of Hillwood Alliance, has requested vacation of these public access easements in Alliance Town Center. The public access easements were dedicated by separate instrument. The City Plan Commission recommended approval of this request at its meeting on March 8, 2023. No replat is required to abandon these easements. The City of Fort Worth (City) originally obtained the above mentioned public access easements through separate instrument dedication. The City does not own any fee interest in the public access easements or own any property adjacent to the public access easements and did not expend any City funds to purchase the public access easements. This project is located in COUNCIL DISTRICT 4 and FUTURE COUNCIL DISTRICT 4. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
