HomeMy WebLinkAboutOrdinance 26153-05-2023ORDINANCE NO. 26153-05-2023 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AVIATION GAS LEASE CAPITAL PROJECTS FUND, FROM AVAILABLE FUNDS, IN THE AMOUNT OF $19,665.00, FOR THE PURPOSE OF FUNDING REPLACMENT OF THE WINDOW SHADES IN THE AIR TRAFFIC CONTROL TOWER (CITY PROJECT NO. 104689); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2022-2023 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Aviation Gas Lease Capital Projects Fund in the amount of $19,665.00, from available funds, for the purpose of funding replacement of the window shades in the Air Traffic Control Tower (City Project No. 104689). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be incorporated into the ordinance effecting the budget of the municipal government of the City of Fort Worth for the ensuing Fiscal Year beginning October 1, 2022, and ending September 30, 2023, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Goodall City Secretary City of Fort Worth, Texas Mayor and Council Communication DATE: 05/09/23 M&C FILE NUMBER: M&C 23-0359 LOG NAME: 55AFW AIR TRAFFIC CONTROL TOWER WINDOW SHADES REPLACEMENT SUBJECT (CD 7 / Future CD 10) Adopt Appropriation Ordinance Increasing Estimated Receipts and Appropriations in the Aviation Gas Lease Capital Projects Fund, in the Amount of $19,665.00 for the Purpose of Replenishing Operational Funding Utilized for Window Shade Replacement for Air Traffic Control Tower at Perot Field Fort Worth Alliance Airport RECOMMENDATION: It is recommended that the City Council adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Aviation Gas Lease Capital Projects Fund, in the amount of $19,665.00 from available funds, for the purpose of replenshing operation funds for window shade replacements at the Air Traffic Control Tower (City Project No. 104689) at Perot Field Fort Worth Alliance Airport. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to adopt the attached appropriation ordinance to increase estimated receopts and appropriations in the Aviation Gas Lease Capital Projects Fund in the amount of $19,665.00, from available funds, to replenish Aviation operating funds for the window shade replace of the Air Traffic Control Tower (ATC Tower) at Perot Field Fort Worth Alliance Airport (Airport). The Federal Aviation Administration (FAA) and window shade manufacturers recommend shades be replaced every 5 to 7 years. The current Airport ATC Tower window shades were installed in 2012, making them over 10 years old. Continual sun exposure fades the material, resulting in shades not being able to sufficiently protect the ATC Tower controllers and equipment from the sun, heat and glare. Other components of the shades like rollers, pulleys and cords also suffer normal 'wear and tear' and need to be replaced. The City recently entered into a contract with an FAA authorized vendor, Plastic -View ATC, in order to replace all required shade parts and materials. Under the contract, the vendor performed the services as required and in order to pay the vendor promptly, the Aviation Department utilized appropriated operational funding. The purpose of this request is to transfer the appropriated operational funding to the City Project No. 104689 in order to properly record this expenditure as utilizing the Aviation Gas Lease Capital Projects Fund. Funding is budgeted in the Unspecified -All Funds project of the Aviation Gas Lease Cap Proj Fund. Perot Field Fort Worth Alliance Airport is located in COUNCIL DISTRICT 7/FUTURE COUNCIL DISTRICT 10. A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are available in the Unspecified -All Funds project within the Aviation Gas Lease Cap Proj Fund and upon approval of the above recommendation and adoption of the attached appropriation ordinance, funds will be available in the Aviation Gas Lease Cap Proj Fund for the AFW FY23 ATC Wnd Shade Replace project. Prior to an expenditure being incurred, the Aviation Department has the responsibility of verifying the availability of funds.
