AN ORDINANCE AMENDING CHAPTER 19, "HEALTH AND
SANITATION, " OF THE CODE OF THE CITY OF FORT
WORTH (1964) , AS AMENDED, BY AMENDING SECTIONS
19-418, 19-420 AND 19-421 THEREOF BY RESPECTIVELY
PRORATING FOR NEW OCCUPATIONS, VOCATIONS AND
BUSINESSES THE PRESCRIBED UNIFORM PERMIT FEE,
DELETING CERTAIN OCCUPATIONS, VOCATIONS AND
BUSINESSES FROM THE REQUIREMENT OF OBTAINING
A PERMIT TO CONDUCT CERTAIN OCCUPATIONS, VOCA-
TIONS AND BUSINESSES, AND DELETING CERTAIN
OCCUPATIONS, VOCATIONS AND BUSINESSES FROM THE
REQUIREMENT OF PAYING A PERMIT FEE TO CONDUCT
CERTAIN OCCUPATIONS, VOCATIONS AND BUSINESSES;
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES AND PRO-
VISIONS OF THE FORT WORTH CITY CODE IN CONFLICT
HEREWITH; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A PENALTY; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That Section 19-418 of Chapter 19 of the Code of the City
of Fort Worth (1964) , as amended, be and the same is hereby amended
so that hereafter same shall read and be as follows:
"Sec. 19-418. Requirements as to fee generally.
"A fee shall be charged for each permit issued
as described in Section 19-421, and such fee
shall be payable in full; provided, however,
that for any new occupation, vocation or business
that commences operation on or after April 1, or
on or before September 30, of any year, said
permitee shall be charged and required to pay
(1/2) of said fee. "
SECTION 2.
That Section 19-420 of Chapter 19 of the Code of the City
of Fort Worth (1964) , as amended, be and the same is hereby amended
so that hereafter same shall read and be as follows:
"Sec. 19-420. Occupations, vocations or
businesses requiring permit enumerated.
"Each person engaged in any of the following
occupations, vocations or businesses whether in
a single building or not shall secure a permit
for each such occupation, vocation or business
as hereinabove provided:
Bakery
Bottling plant
Cafe
Candy store
Dining room
Food factory
Food peddler
Grocery store
Hamburger stand
Hotel (lodging only)
Lunch counter
Meat market
Motel (lodging only)
Place of public amusement
Public swimming pool
Restaurant
Soda fountain
Soft drink establishment
Theatre
Tourist camp (lodging only)
Tourist court (lodging only)
Transient stock company
Water distributor
Watermelon stand
SECTION 3.
That Section 19-421 of Chapter 19 of the Code of the
City of Fort Worth (1964) , as amended, be and the same is hereby
amended so that hereafter same shall read and be as follows:
"Sec. 19-421. Amount of fee.
"A fee of $60.00 shall be charged and paid
by the permittee for each permit issued
under the provisions of this Article on
each of the occupations, vocations, or
businesses hereafter listed. In cases
where a permittee conducts any such occupa-
tions, vocations or businesses at more than
one location a separate permit will be re-
quired, and the amount of the fee shall be
computed separately for each such location.
In cases where a permittee conducts under
one roof more than one such occupations,
vocation or business, a separate permit will
be required, and the amount of the fee shall
be computed separately for each such occupa-
tion, vocation or business.
"The following occupations, vocations or
businesses are included within the provisions
of this section:

"Bakery
"Bottling plant
"Cafe
"Candy Store
"Dining Room
"Food Factory
"Food peddler
"Grocery store
"Hamburger stand
"Hotel (lodging only)
"Lunch counter
"Meat market
"Motel (lodging only)
"Place of public amusement
"Public swimming pool
"Restaurant
"Soda fountain
"Soft drink establishment
"Theatre
"Tourist camp (lodging only)
"Tourist court (lodging only)
"Transient stock company
"Water distributor
"Watermelon stand
"Any other occupation, vocation or business where
food or drink for human consumption is manufac-
tured, stored, sold or offered for sale, or given
away or given in exchange, excepting, however,
those places regulated under city ordinances con-
cerned with a distinct industry, occupation, voca-
tion or business for which a permit fee is desig-
nated in such ordinances.
"A separate permit shall not be required for the
retail sale of each of various types of food pro-
ducts under one roof if food is not actually pre-
pared or processed on the premises, and provided
that the business establishment where such items
are sold to the public is covered by a valid
health permit.
"No fee shall be charged on the following occu-
pations, vocations or businesses:
"Hospital
"Maternity home
"Private school
"Children's boarding home."
SECTION 4
That this ordinance shall repeal every prior ordinance
and provision of the Code of the City of Fort Worth (1964) , as

amended, in conflict herewith but only insofar as the portion of
such prior ordinance or provision shall be in conflict, and as
to all other ordinances or provisions of such Code not in direct
conflict herewith, this ordinance shall be and is hereby made
cumulative.
SECTION 5.
That if any section, part of a section or provision
of any section of this ordinance shall be held to be void, in-
effective or unconstitutional by a court of competent juris-
diction, the holding of such section, part of a section or
provision of any section to be void, ineffective or unconsti-
tutional for any cause whatsoever shall in no way affect the
validity of the remaining sections and provisions of this
ordinance, which shall remain in full force and effect. The
City Council would not have passed any sections, parts of
sections or provisions of any section of this ordinance that
were unconstitutional, void or ineffective at the time of
adopting this ordinance.
SECTION 6.
That any person, firm or corporation violating any
of the provisions of this ordinance shall be fined in any sum
not to exceed Two Hundred Dollars ($200000) and each day's
violation thereof shall constitute a separate offense.
SECTION 7.
That this ordinance shall be in full force and effect
from and after its passage and publication as required by law.

At the City Council meeting of October 18, 1976, Council directed staff to
prepare an ordinance deleting the Health Permit Fees for Barber and Beauty
Shops and providing for prorating of fees for partial year opegation of
all other Health Permits as described in CP-16, dated 'October 1,1, 1976.
The Department of Law has prepared the attached ordinance for City Council
cons'ideration incorporating the requested changes. It includes provision
for charging one half the standard fee for any business opened 'between
April, 1 and September 30 of any year.
Recommendation
It is recommended that the City Council approve the proposed Ordinance
amending Chapter 19 , "'Health and Sanitation", of the Code of the City of
Fort,yWortb.
