ORDINANCE NO. 7445 AN ORDINANCE VACATING, ABANDONING AND CLOSING THE PUBLIC EASEMENTS, STREETS, ALLEYS, PUBLIC THOROUGHFARES, AND RIGHTS-OF-WAY LYING WITHIN BLOCKS 84 AND 85, FOSTEPCO HEIGHTS ADDITION; BLOCKS 87 AND 88, M. G. ELLIS ADDITION; TRACT 6, A. ANDERSON SURVEY; TRACT 1, W. M. GRAY SURVEY; AND THE 3100 BLOCK NORTH COMMERCE STREET; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH AND PROVIDING THAT THIS ORDINANCE SHALL BE- COME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the public easements,streets, alleys, public thorough- fares, drainage ways, utility easements and rights-of-way lying in, through, upon, across and within the hereinafter described properties: Street: North Commerce Street in the 3100 block a width of 50' and 100' in length south from N. W. 32nd Street abutting Lots 1 and 2, Block 84, and Lots 3 and 4, Block 85, Fostepco Heights Addition to the City Of Fort Worth; and North Commerce Street in the 3100 Block 60' in width and approximately 120' in length abutting Lots 12 and 13, Block 87, and Lots 10 and 11, Block 88, M. G. Ellis Addition to the City of Fort Worth; Alleys: Fostepco Heights Addition, Block 85, Lots 1-4, 15' in width and 100 feet in length; Fostepco Heights Addition, Block 84, Lots 1-4, 15' in width and 100 feet in length; M. G. Ellis Addition, Block 87, Lots 10-13, 20' in width and 120' in length; M. G. Ellis Addition, Block 88, Lots 10-13, 20' in width and 120' in length; be and the same are hereby closed, abandoned and permanently vacated as easements, streets, alleys, public thoroughfares and rights-of-way of any kind or character whatever. SECTION 2. That the fee to the land in the above described public easements, streets, alleys, public thoroughfares and rights- of-way located in the hereinabove described real property are hereby released and will revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are reserved for any and all existing utilities including an easement for sanitary sewer facilities in Block 85, Fostepco Heights Addition and Block 88, M. G. Ellis Addition to the City of Fort Worth. SECTION 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained. Ellis Addition, Block B , Lots 10-13, 20 feet, in width and 120 feet in length; M.G. Ellis Addition, Block Bd, Lots 10-13, feet in width and 120 feet in length. Subject street and allay rights-of-gray, acquired by dedication, are neither open nor improved except for the alley right-of-way in block 85, which is open but not "Improved. The alley rights-of-way in blocks 85 and 88 contain sanitary serer facilities. The Water department requests a utility easement be provided for these facilities. Reviewing City departments and private utility companies have no objections to this request provided subject rights-of-way are repl.att^ed with adjacent lard, easements are retained in alleys in blocs 33 and 88 for existing utilities; alleys and North Commerce Street are physically closed Frith. standard curb and Butter along 32nd Street when street: improvement occurs and a turn around is reserved at the north terminus of North Coi=eroe Bt. The City Plan Commission has reviewed this request and recommends that an ordinance be adopted vacating, subject rights-of-way as requested. A satisfac- tory replat has been submitted to the City Staff.
