HomeMy WebLinkAboutOrdinance 7541 ORDINANCE NO. -7 !E5 L� "q AN ORDINANCE VACATING, ABANDONING AND CLOSING THAT CERTAIN DRAINAGE AND UTILITY EASEMENT 15' IN WIDTH AND 170' IN LENGTH, THE CENTERLINE OF WHICH IS COLLINEAR WITH THE COMMON BOUNDARY LINE OF LOTS 15 AND 16, BLOCK 23, RIDGECREST ADDITION TO THE CITY OF FORT WORTH, AND WHICH EASEMENT EXTENDS FROM THE FAST RIGHT-OF-WAY LINE OF STATE HIGHWAY 377 TO A POINT 30' FROM THE EASTERLY PROPERTY LINES OF SAID LOTS 15 AND 16; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the drainage and utility easement 15' in width and 170' in length, the centerline of which is collinear with the common boundary line of Lots 15 and 16, Block 23, Ridgecrest Addition to the City of Fort Worth, and which easement extends from the east right-of-way line of State Highway 377 to a point 30' from the easterly property lines of said Lots 15 and 16, be and the same is hereby vacated, abandoned and permanently closed as an easement for drainage and public utilities. SECTION 2. That the fee to the land in the above described drainage and utility easement is hereby released and will revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained. APPROVED AS TO FORM AND LEGALITY: S. G. S. for 1 4/26/77 PZ-789 HighwM South of Pensacola (V-77-17) Mr. Bill Wisdom, owner of all abutting property, has requested that the City vacate a drainage and utility easement a width of 15 feet and a length of 170 feet. The subject easement is collinear with the common line of Lots 15 and 16, Block 23, Ridgecrest Addition, and extends from the east right-of-way line of State Highway 377 to a point 30 feet from the east property lines of Lots 15 and 16, as shown on the attached map. The subject easement is not in use for either drainage or utilities and the easement area is presently vacant. City departments have reviewed this request and recommended approval provided that the abutting property is replatted removing the easement. A satisfactory replat has been submitted to City Staff. Recomotendation It is recommended that an ordinance by adopted vacating the subject easement as requested.
