HomeMy WebLinkAboutOrdinance 7543 ORDINANCE NO. -7 5 q-3 AN ORDINANCE ABOLISHING IN THE FIRE DEPARTMENT ONE POSITION IN THE CLASSIFICATION OF FIRE CAPTAIN; CREATING IN THE FIRE DEPARTMENT ONE POSITION IN THE CLASSIFICATION OF FIRE PRIVATE; PROVIDING A SEVERABILITY CLAUSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That one (1) position in the classification of Fire Captain in the Fire Department, now vacant, shall be abolished. SECTION 2. That one (1) position in the classification of Fire Private in the Fire Department is hereby created. SECTION 3. That if any section, part of a section or provision of any section of this ordinance shall be held to be void, in- effective or unconstitutional by a court of competent juris- diction, the holding of such section, part of a section or provision of any section to be void, ineffective or un- constitutional for any cause whatsoever shall in no way affect the validity of the remaining sections and provisions of the ordinance, which shall remain in full force and effect. SECTION 4. That this ordinance shall become effective and be in pry full force and effect from and after the date of its passage as provided by law, and it is so ordained. To realize certain measures of efficiency and economy the Council approved the deletion of seven Fire Captain positions and the creation of seven positions of lower rank to replace those positions. At the time of implementation, the Council decided to delete the Fire Captain positions through attrition so that no incumbent personnel would be adversely affected. One of the seven Fire Captain positions will be vacant a,s of blay 1, 1977 and needs to be replaced with one Fire Private position in order to continue phasing in the reorganization plan. A provision in the Firemen's and Policemen's Civil Service Statute, Article 1261m, Section 8, states that the City Council "sball prescribe by ordinance the number of positions of each classification" of all firemen and policemen. Therefore, to be consistent with the provisHns of Article 1269m, it is necessary to amend the number of Fire Captain, positions and Fire Private positions by ordinance. Recommendation It is recommended that the City Council approve an ordinance amending the authorized personnel in the Fire Department by deleting one Fire Captain position and adding one Fire Private position.
