HomeMy WebLinkAboutOrdinance 7636 ORDINANCE NO. 7 � 3 AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE- MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF EAST ROSEDALE STREET AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im- proved by raising, grading and filling same and by constructing thereon the following, to-wit: From Ayers .Avenue to 200' east of Stalcup Road, known and designated as Project No. 104-2S000- 207, A four-inch- thick hot-mix asphaltic concrete surface course on existing concrete base and re- placing existing gravel base with five-inch thick hot-mix asphaltic concrete base, on a sixty-foot roadway. Seven-inch high concrete curb and two- foot wide concrete gutter will be constructed where faulty or non-existant. Six-inch thick concrete driveways will be constructed where specified. together with concrete curbs, gutters, driveways and incidentals to such improvements on proper grade and line where same are not already so constructed, together with storm sewers and drains and other necessary incidentals and appurtenances; all of said improvements are to be constricted as and where shown on the Plans and in strict accordance with the Plans and Specifications therefor; and contract has been made and entered into with Austin Road C�an for the making and construction of such improvements, Estimates of the cost of such improve- ments on each said portion of street, avenme and public place have been prepared. The portions of streets, avenues and public places so to be improved , together with the estimated cost of the improvements for each such portion, and the amount per front foot proposed to be assessed against the abutting property and the owners thereof on each portion of street, avenue and public place are as follows; EAST ROSEDALE STREET From Ayers Avenue to 200' east of Stalcup Road, known and designated as Project No. 104-25000-207. The estimated cost of improvements is $ 1,347,311.41 the estimated amount per front foot to be assessed against abutting property and the owners thereof for concrete curb and gutter is $ 4.71 the estimated amount per front foot to be assessed against abutting property and the owners thereof for pavement is $ -0- the estimated amount per front foot to be assessed against abutting property and the owners thereof for -0- wide concrete sidewalk is $ -0- ; the esti- mated amount per square foot to be assessed against abutting property and the owners thereof for 6-inch thick concrete driveway is $ 1.75 per square foot; the total estimated amount per front foot to be assessed against abutting property and the own- ers thereof is $ 4.71 plus the cost incurred for concrete driveway con- struction where specified. The estimated cost of improvements is the estimated amount per front foot to be assessed against abutting property and the owners thereof for concrete curb and gutter is $ ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for pavement is $ the estimated amount per front foot to be assessed against abutting property and the owners thereof for wide concrete sidewalk is $ ; the estimated amount per square foot _t_Tbe assessed against abutting property and the owners thereof for 6-inch thick concrete driveway is $ per square foot; the total estimated amount per front foot to be assessed against abutting property and the owners thereof is $ J0 plus the cost incurred for concrete driveway construction where specified, A hearing will be given and held by and before the City Council of the City of Fort Worth, Texas, on the 25th - day of October ', 1977 at 9.30 A.M. , in the Council Chamber of the City Hall in the City of Fort Worth, Texas, to all owning or claiming any property abutting upon said portions of streets, avenues and public places, and to all owning or claiming any interest in any such property. At said time and place, all owning or claiming any such abutting property or any interest therein shall appear and will be fully heard concerning said improve- ments, the cost thereof, the amounts to be assessed therefor, the benefits to the respective parcels of abutting property by means of the improvements of said por- tions of streets, avenues and public places upon which the property abuts and con- cerning the regularity, validity and sufficiency of the contract for, and all pro- ceedings relating to such improvements and proposed assessments therefor, and con- cerning any matter as to which they are entitled to hearing under the law in force in the City of Fort Worth, Texas, and under which these proceedings are taken and had under the proceedings of the City with reference to said matters . Following such hearing, assessments will be levied against properties and the owners there- of and such assessments, when levied, shall be a personal liability of the owners of such property and a first and prior lien upon the property as provided by the law under which these proceedings are taken and had, being the Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, known as Chapter 106 of the Acts of said Session, now known as Article 1105b of Vernon's Texas Civil Statutes as amended by Acts 1967, 60th Legislature, Section 1, Page 365, Chapter 176, emergency effective May 12, 1967; which Act has been adopted as an amendment to and made a part of the Charter of the City of Fort Worth, Texas. The improvements on each said portion of street, avenue and public place con- stitute an entirely separate and distinct unit of improvements, all to the same ex- tent as if entirely separate and distinct proceedings have been taken and had with reference to the improvements and assessments therefor in connection with the im- provements on any such portion of street, avenue and public place, and the assess- ments against the property abutting upon any one unit shall be and are in nowise affected by any fact or circumstance relating to or connected with the improvements in any of the other units. Of all said matters and things, all owning or claiming any such property or any interest therein, as well as all others in anywise affected or interested, will take notice. Street Limits Width-Feet dth-Feet East Rosedale Ayers to 2001 60 80 East of Stalcup The 1976-78 Capital Improvement Program (Pages D-1 to D-3) provides for resurfacing and/or reconstruction of existing permanently paved streets. Streets were selected on the basis of need for resurfacing/reconstruction, high maintenance costs, and traffic demands. IROLOVec IL_ East Rosedale will be reconstructed by repairing the existing concrete base where aecessary; replacing the existing gravel base with major thoroughfare grade hot-mix asphaltic concrete base; and constructing a new hot-mix asphaltic concrete surface course on the entire width of the street. Concrete curb, gutter and driveway approaches will be replaced where necessary due to deterioration and where none presently exist. Also included is an extensive storm drain system in the Ayers/East Rosedale area and minor extensions in the Rosedale Plaza area. ids The following bids were receimed on September 8, 1977: Austin Road Campany $1,247,510.57 Texas Bitulithic Company 1,343,337.40 WorkIng Days Allotted - 250 Standard City policy states that under street resurfacing and reconstruction, where streets are not widened, property owners shall not be assessed any portion of the cost except for new curb and gutter, driveway approaches and sidewalks where none existed before. Accordingly, $17,151.47 is proposed to be assessed against abutting properties. Funds for, the property owners' share of construc- tion costs will be provided for by a bond fund transfer from the RevoINK9 Fund Unspecified. Total cost to the City for construction, including engineering, is estimated to be approximately $1,330,159.94.
