After construction began, Contractor surveyed the proposed project improvements and noted the conflicts that were present. Contractor also started drilling the signal shafts for the project. During construction of the shaft, it was noticed that ground water was present in the shaft location. The shaft installation was halted until a solution was received. As part of the redesign needed to clear the conflicts from the development, the signal shaft was moved due to sidewalk adjustments needed to keep a new retaining wall and revised sidewalks on the ROW. The existing drilled shaft hole was abandoned, and signal contractor was required to mobilize an additional time to place the shaft in the new location. Additionally, during construction existing pavement and curbs were noticed to be failing after the asphalt surface was milled. Those locations were directed to be removed and replaced to correct the issues prior to the asphalt overlay at the end of the project. Pavement markings were adjusted to remove bus turn lanes after confirmation with Trinity Metro that the bus routes no longer service locations in the plans along Long Ave. Cost: Contractor has submitted cost based on mobilization and rework associated with the drilled shaft being relocated after the hole was started. The backup data has been reviewed and determined to be fair and reasonable. It is understood and agreed that the acceptance of this Change Order by the contractor constitutes an accord and satisfaction and represents payment in full (both time and money) for all costs arising out of, or incidental to, the above Change Order. The Project/Program Manager signing below acknowledges that he/she is the person responsible for the monitoring and administration of this contract, including ensuring all performance and reporting requirements. So, we procured the materials and started making the proper arrangements to get the foundation in as quickly as possible. Once we got all resources on -site to take the necessary steps to proceed it was brought to our attention that the design was changed and that what we originally planned for and been approved of doing had changed. In turn we had to shift our plan for the day and send equipment and materials back to the shop. Bean has absorbed a lot of costs related to the original location of the foundation due to unforeseen conditions and the plan modifications made on the fly. The revised location of foundation T-4 is in conflict with the location of conduit run #18. This conduit run will have to be relocated in order to install the foundation per revised location. Conduit run #15 was installed to the original location prior to the revised location being presented. Thie conduit installed will have to be abandoned and the revised conduit run #15 will need to be installed. While TxDOT Specification 416 for the drill shaft addresses water, and the contractor appeared to offer a solution that would likely comply with the specification, the location of T-4 was no longer suitable due to the wall necessary to address the new site conditions caused by the development on the SW corner of the intersection. Therefore, as a result of the conflict with the newly proposed wall, foundation T-4 should be relocated to the location shown in the updated plans attached to this transmittal. In the plans attached, Pole T-4 is near the previous location of pole P-6. Pedestal pole P-6 has been eliminated from the plans and the signal and pedestrian heads and APS units from P-6 will now be installed on T-4. The plans show Pole T-4 (controlling southbound Angle Ave) orientated such that the mast arm does not block the view of eastbound Long Avenue signal heads. Because the new location of pole T-4 is immediately next to the existing pedestal pole on the SW corner, it may be necessary for the contractor to adjust the height of the existing signal head, or remove the backplate on the existing head to install the pole and mast arm T-4 at the proper orientation. Due to the proposed orientation of the mast arm T-4 and the ultimate location of signal head 17, Lee Engineering recommends adding a new left -turn "pull through" signal head to signal pole T-3. This new head is shown in the plans as signal head 15A.
