Vacation of `asement: North a PAGE WORTH,H SAID° ,,I�PiF /ly/79 NUMBER-914 Business Center, Lot 9-R I ate_ 1 4, u x l "our-Way Properties, Inc. , owner of loot 9--R, Worth Park Business Center, has requested that the City vacate the north/south utility easement in Lot 9-R, a width of 15' and a length of 24.x' excluding any part of the 15' utility x�„ easement along the south line of Lot 9-R, and any part of the 15' northeast/ southwest utility easement in Lot 9-R, and any part of the 46.51 emergency access and utility easement along the north line of Lot 9-R, or as shown on the attached map and more fully described, in the attached metes and bounds description. The subject easement, acquired by dedication, presently contains a sanitary sewer facility, but no other underground utility facilities or surface improvements. Reviewing City departments and private utility companies have raised no objection to this request provided the existing. sanitary sewer line is relocated at the property owner's expense. The Water Department has stated that a contract has been awarded and a letter of Credit has been submitted by the property owner assuring the relocation of the sanitary sewer within already existing utility easements. A replat of Lot 9--R has been submitted to City staff. Recommendation It is recommended that the subject easement be vacated.
